영문 초록

Our Civil Law has the express provision for the recovery of possession under the case which a possessor and a proprietor form the relations with the delivery of any object between themselves. Especially, an article 201 of the Civil Law sets a special treatment of unjust profit during the occupation of the object by the former which is bound to returned. In other words, the possessor with good faith acquires the ownership regardless of consumption of fruits because he is free from the obligation to return acquisition of fruits. But, if a wrong possessor cause to damage or the failure to obtain fruits owing to misfeasance, he shall make up for equivalents instead of restitutions as well as restore acquisition of fruits who is not necessary to protect.
