영문 초록
The Priority between the subrogation of Hypothec and the subrogation of pledge is entirely up to the viewpoint - is insurance money the subrogation of Hypothec, what is legal nature of the subrogation, Does it means "grant and delivery" in civil code § 342 giving to pledge.
Judicial precedent in view of the results so far achieved approve that the subrogation of pledge is prior to the subrogation of Hypothec.
But that is not suited to the purpose Hypothec, if the purpose of subrogation(of Hypothec) is for mortgager, we should approve that the subrogation of Hypothec be prior to the subrogation of pledge.
