영문 초록

The place of arbitration, the governing law, arbitration costs, the arbitration institution, the number of arbitrators and the appointment of arbitrators are very important factor inserted in the arbitration clause in international transactions. Among them, the place of arbitration and the arbitration institution are the first requisite for good arbitration. The major point at issue in these two cases introduced herein are the elucidation and composition of the arbitration tribunal and the duplication of the arbitration procedure. Accordingly, by presenting and examining two arbitration cases rendered in the China International Economic and Trade Arbitration Commission, this pater seeks to recommend a method to help businessmen in the field of international trade cope with the aforementioned issues when inserting an arbitration clause in their agreement.
