학교폭력대책심의위원회의 문제점과 개선방안

국문 초록

학교폭력예방법 개정 후 학교에 설치되었던 자치위원회는 교육원지원청에 설치되는 심의위원회로 변경되었다. 본 연구는 변경된 심의위원회의 문제를 분석하고 개선안을 탐색하였다. 이를 위해 부산·경남 심의위원들을 대상으로 초점집단면접(FGI)을 실시하여 분석하였다. 연구결과, 자치위원회의 문제인 학부모위원의 편중과 비전문성, 형식적 운영, 피해학생에 대한 소극적 조치, 가해학생 조치의 일관성 미흡 등을 반복하였다. 학교의 소극적 대처, 조사관에게로의 전가, 사립학교의 은폐·축소, 심의개최지연, 교장위주 위원장 선임, 간사의 역할남용, 위원장의 조치결정 유도, 편파적 재임용 등은 새로운 문제로 도출되었다. 개선안은 법개정을 통한 학부모위원 감축, 재임용 절차 개선, 가해학생 조치기준 재검토, 위원장 선발방식의 개선 등을 제안하였다.

영문 초록

After the revision of the School Violence Prevention Act, the autonomy committee established in schools was changed to a review committee established in the Education Support Agency. This study analyzed the problems of the changed council and explored ways to improve it. To this end, focus group interviews(FGIs) were conducted with deliberative council members in Busan and Gyeongnam and analyzed. The results of the study reiterated the problems of the autonomous council, which include the bias and unprofessionalism of parent members, formalized operation, passive action against victimized students, and inconsistent action against perpetrators. New problems were identified, such as passive response by the school, transfer to the investigator, concealment and reduction of private schools, delayed deliberations, appointment of the chairperson in favor of the principal, abuse of the role of the secretary, inducing the chairperson to take action, and biased reappointment. Recommendations for improvement included reducing the number of parent members through legislative amendments, improving the reappointment process, reviewing the criteria for taking action against offending students, and improving the selection method for chairpersons.
