국문 초록

발달장애인에 대한 노동력 착취에서부터 시작하여 발달장애인을 타겟으로 한 휴대폰 개통사기에 이르기까지, 우리는 발달장애인에 대한 경제적 착취 피해 사례를 일상에서 자주 마주하고 있다. 발달장애인에 대한 이러한 경제적 착취는, 당사자가 경제활동으로 나아가는 데 걸림돌로 작용하여 결국 발달장애인의 사회통합을 저해하는 결과로 이어질 수 있다는 점에서, 문제 해결을 위한 공동체의 특별한 노력이 요청된다. 경제적 착취 예방과 피해 회복에 이르는 더 나은 방향을 제시하기 위하여 법제적 관점에서 문제 유형을 분석하고 대안을 모색하는 논의가 필요하다. 이에 본 연구에서는, 발달장애인 경제적 착취 및 피해 대응 현황을 검토하고(제Ⅱ장), 대표적인 경제적 착취 유형으로서 휴대폰 개통사기 피해 사례에 관하여 체계적으로 분석하고 실효적인 대응체계 마련을 위한 새로운 분류 모델을 수립합으로써 법제적 이해를 시도하고자 한다(제Ⅲ장). 다음으로 당사자 경험을 중심으로 피해유형별 문제를 진단하는 한편, 법률복지 관점에서의 문제점과 법제적 개선방향에 관하여 논의하고자 한다(제Ⅳ장). 이를 통해 발달장애인 경제적 착취 발생의 예방과 피해 회복을 위하여 법률복지의 과제를 종합하여 제시하기로 한다(제Ⅴ장). 발달장애인이 경제적 착취로부터 자유로울 권리를 보장하기 위하여, 당사자의 피해경험에 주목하여 피해자 중심 구제 체계 마련의 필요성에 관하여 고찰한 본 연구를 디딤돌 삼아, 향후 법률복지의 관점에서 보다 근본적이며 종합적인 법제 및 정책 개선을 설계하고 이행해 나갈 수 있기를 기대한다.

영문 초록

From labor exploitation for people with developmental disabilities to mobile phone opening fraud targeting people with developmental disabilities, we often face cases of economic exploitation damage to people with developmental disabilities in our daily lives. Since such economic exploitation of people with developmental disabilities can act as an obstacle to the progress of economic activities and eventually lead to social integration of people with developmental disabilities, special efforts of the community to solve the problem are required. In order to suggest a better direction to prevent economic exploitation and recover damage, discussions are needed to analyze problem types and seek alternatives from a legal perspective. Therefore, this study examines the current status of economic exploitation and damage response for people with developmental disabilities (Chapter II), systematically analyzes the cases of mobile phone opening fraud as a representative type of economic exploitation, and attempts to understand the legal system by establishing a new classification model for effective response system (Chapter III). Next, while diagnosing problems by type of damage based on the experiences of the parties, we will discuss problems from the perspective of legal welfare and directions for legal improvement (Chapter IV). Through this, the tasks of legal welfare will be comprehensively presented to prevent the occurrence of economic exploitation and recover damage for people with developmental disabilities (Chapter V). In order to guarantee the right of people with developmental disabilities to be free from economic exploitation, it is expected that more fundamental and comprehensive legal and policy improvements can be designed and implemented from the perspective of legal welfare in the future by using this study as a stepping stone on the necessity of preparing a victim-centered relief system by paying attention to the victim's experience.
