국문 초록

북한은 2014년 ‘사회주의기업책임관리제’를 발표하고 『기업소법』 개정을 통해 기업의 경영원칙을 명시하였다. 이 경영원칙은 ①계획권, ②생산조직권, ③관리기구·노력조절권, ④제품개발권, ⑤품질관리권, ⑥인재관리권, ⑦무역·합영·합작권, ⑧재정관리권, ⑨가격제정권·판매권이다. 이 법은 분명 개혁적이었다. 내용적인 측면에서 보면 북한 정권이 기업에 경영권을 이관하고 기업이 주체적으로 경영할 수 있는 환경을 조성한 것으로 보인다. 하지만 경영권과 관련된 법률의 제정 및 개정과정을 살펴보면 북한이 『기업소법』 외의 법률에서 기업의 경영권을 통제하는 조항을 명시한 것을 알 수 있다. 이러한 법률체계의 내용에 비춰봤을 때, 북한 기업의 경영권은 자율성에 있어서 그 폭이 크지 않다. 최근에 제정, 개정된 기업소의 통제적 성격과 관련된 법률은 사회주의기업책임관리제의 현실 적용에 있어서 나타나는 불법적인 행위, 부작용 등을 반영한다. 북한의 법률체계에서 기업에 부여한 경영권은 대부분 유통 활성화에 연계되어 있다. 북한은 유통 활성화의 목적이 북한 당국의 자금 확보에 있다는 것을 밝히고 있다. 결국 기업의 자율권은 일정 부분 인정한 ‘사회주의기업책임관리제’가 지속되는 것은 북한 정권과 체제안정을 위해 필요한 자금을 확보하기 위한 것으로 판단된다.

영문 초록

In 2014, North Korea issued the “Socialist Enterprise Responsibility Management System” and amended the “Business Law” to specify the management principles of enterprises. These management principles are: (1) the right to plan, (2) the right to organize production, (3) the right to control management mechanisms and efforts, (4) the right to develop products, (5) the right to control quality, (6) the right to manage human resources, (7) the right to trade, cooperation and joint ventures, (8) the right to manage finances, and (9) the right to set prices and sell. The law was clearly reformist. In terms of content, it appears that the North Korean regime has transferred management control to enterprises and created an environment in which enterprises can manage themselves. However, if we look at the process of enacting and revising laws related to management rights, we can see that North Korea has specified provisions in laws other than the Enterprise Law that control the management rights of enterprises to a large extent. Based on the content of this legal system, North Korean companies do not have much autonomy in terms of management rights. As a result, the recently enacted and revised laws related to the controlling nature of enterprises reflect the illegal behavior and adverse effects of the socialist enterprise responsibility management system in practice. The management rights granted to enterprises in North Korea's legal system are all tied to revitalization. North Korea has made it clear that the purpose of activating circulation is to secure funds for the North Korean authorities. In other words, the continuation of the "socialist enterprise responsibility management system,” which recognizes some autonomy for enterprises, is believed to be aimed at securing funds for the North Korean regime and system stability.
