대학 비정년트랙교원 제도의 법제적 논쟁점에 관한 연구

국문 초록

헌법 제31조에는 교원의 지위를 명시하고 있다. 헌법에서 교원지위법정주의를 명시한 것은 교원의 지위를 보장하여, 교원으로 하여금 학문 자유를 확실하게 보장하기 위함에 있다. 비정년트랙 교원제도는 철폐되거나 개선되어야 할 인사 제도이다. 비정년트랙교원 제도를 위법률을 분석틀로 하여 제도의 위법성을 분석하였다. 분석 결과 헌법, 교육관련법, 노동법 위반 소지가 있다. 헌법에서 교원의 지위를 명하고 있다. 교원의 지위향상 및 교육활동보호를 위한 특별법 등이 운영되고 있으나, 실제 고등교원의 교권에 대한 관련법이 미흡하여 비정년트랙 교원의 교권 보장이 이루어지지 않고 있다. 비정년트랙교원의 교권 보장이 미진한 책임으로 행정부에게 행정부작위를 적용할 수 있다. 비정년트랙교원 문제는 노동 시장에서 벌어지는 비정규직 문제라 할 수 있다. 따라서 대학의 비정년트랙 교원문제의 해결은 노동시장 전반에 걸친 비정규직 문제 해결에 있어서 중요한 의미를 가질 수 있다. 사회구조적 관점에서 비정년트랙교원 문제에 접근해야 하며 교육현장에서 나타나는 비정규직으로 대변되는 노동 불평등 문제를 해결하기 위한 국가의 적극적 노력이 요구된다. 연구결과를 토대로 차별제도 개선을 위한 법제적․사회운동적 제언을 하였다.

영문 초록

Article 31 of the Constitution stipulates the status of teachers. The fact that the constitutional principle of teacher status is statutory guarantees the status of teachers. And it is to ensure the academic freedom of teachers. The non-tenure track Professors system is a personnel system that needs to be abolished or improved. The non-tenure-track teacher professors was analyzed from a legal point of view. As a result of the analysis, there is a possibility of violating the Constitution, education-related laws, and labor laws. The constitution mandates the position of teachers. There is a law to improve the status of teachers. Because the related laws on teaching authority are insufficient, the teaching authority of non-tenure track professors is not guaranteed. Inadequate action in guaranteeing the teaching rights of non-tenure-track professors is the government's failure to fulfill its obligations. The problem of non-tenure track professors can be said to be a problem of non-regular workers in the labor market. Therefore, solving the problem of non-tenure track professors in universities can have important meaning in solving the problem of non-regular workers in the overall labor market. The problem of non-tenure track professors must be approached from the point of view of the social structure. Therefore, the state's active efforts are required to solve the problem of labor inequality represented by non-regular workers in the educational field. Based on the results of the study, a legal and social movement proposal was made to improve the discrimination system.
