승부조작과 불법인터넷스포츠도박에 대한 공법적 규제

국문 초록

본 논문은 승부조작에 대응하는 수단으로서 대한체육회 등 공적인 성격을 가지는 기관이 승부조작에 가담한 선수나 소속 스포츠단체에 대하여 행하는 공법적(행정적) 제재에 관한 법률관계를 분석하는 것을 연구의 목표로 하고 있다. 대한체육회는 순수한 사법상의 사단법인이 아니라 특별한 체육행정을 목적으로 제정된 공법상의 사단법인으로서 공공기관에 해당하기 때문에 승부조작사건이 발생한 경우 대한체육회가 소속 스포츠단체에 대하여 하는 제재는 민사상 제재라기보다는 행정적 제재에 해당한다. 따라서 대한체육회와 소속 스포츠단체와의 사이는 특별권력관계에 해당한다고 할 수 있지만 대한체육회가 공공기관에 해당한다는 이유로 대한체육회와 소속 스포츠단체와의 모든 법률관계가 공법관계라고는 할 수 없다는 점을 서술하였다. 이런 점에서 대한체육회와 스포츠단체와의 사이에 법적인 분쟁이 발생하면 행정소송으로 다투어야 할지 아니면 민사소송으로 다투어야 하는가에 대한 서술도 하였다. 또한 스포츠행정을 관장하는 문화체육관광부는 승부조작을 근절하기 위한 제도적 방안으로 향후 승부조작사건이 발생할 경우 승부조작사건이 발생한 경기종목의 경기주최단체에 지원해오던 스포츠토토 수익금을 배분하지 않기로 하였는데 이 경기단체 지원금의 공법적 성격에 대해서 서술하였다.

영문 초록

The research goal of this thesis is to analyze legal relations on (administrative) restrictions of public law that institutions with a public character such as Korea Sports Council, etc. enforce athletes participating in victory fabrication or attached sports associations as a means responding to victory fabrication. When a victory fabrication case occurred, the Korea Sports Council is not a pure judicial cooperation, but is a cooperation of public law that is legislated for the purpose of adminstration of special physical education, so because it corresponds to a public institution, restrictions that the Korea Sports Council enforces on attached sports organizations are not civil restrictions, but correspond to administrative restrictions. Accordingly, though it can be said that the relation between the Korea Sports Council and attached sports associations correspond to a special authority relation, it was stated that the legal relations between the Korea Sports Council and attached sports associations cannot be fully said as a public law relation by the reason that the Korea Sports Council corresponds to a public institution. In this aspect, if legal disputes between the Korea Sports Council and attached sports associations occur, there are discussions about whether it should be handled as an administrative litigation or handled as a civil suit. In addition, the Ministry of Culture, Sports and Tourism controlling sports administration have decided not to distribute profits of Sports ToTo that have supported game-hosting associations of sport entries that a victory fabrication case occurred as a systematic method for eradicating victory fabrication, when the victory fabrication case occurred in the future, and this research has stated the support fund of sports associations like this.
