영문 초록

This paper studies the product liability to electricity. Electricity is a special product that is different from an automobile or electric home appliances, etc. Also it is an immaterial being, a public goods. It has the essential dangerousness, the seriousness of an accident and the difficulty of getting to the bottom of case. In general, product means all movables, with the exception of primary agricultural products and game, even though incorporated into another movable or into an immovable. Electricity is product as a produced or processed movable in product liability act. It is very difficult to look upon any problem in electricity as its defect. But if a product of electricity is defective when it does not provide the safety which a person is entitled to expect, producer is liable for damage to health and property. In particular, there are two opinions if electricity failure is defective or not. But it is a majority opinion that electricity failure is not defective.
