국문 초록

항공기내 난동행위는 예상치 못한 행동으로 국제선과 국내선 등 국적을 가리지 않고 발생하고 있다. 항공기내의 난동행위는 항공운송 성장의 어두운 면의 하나로 우리나라는 항공보안법 제2조에서 용어의 정리와 함께 불법행위에 대한 기준을 규정하고 있다. 끊임없이 발생하는 항공기내의 난동행위의 발생원인은 항공기내의 음주와 흡연, 그리고 서비스 질에 대한 불만 등을 대표적으로 들 수가 있다. 이에 따라 항공기내의 난동행위에 대한 처벌 강화를 목적으로 하는 항공보안법이 개정되어 처벌수위가 상향조정되었지만 형량의 상향조정만으로는 근본적인 해결책이 될 수 없다. 즉, 항공기내 보안요원제도의 가장 큰 문제인 보안요원의 전문성이 결여된 문제와 보안요원의 사법경찰관리로서 직무와 권한의 한계, 보안요원으로서의 훈련 미흡 등에 대한 문제점을 극복해야 한다. 이와 같은 항공기내 보안요원의 전문성을 확보하고 항공기 내의 승무원이 보다 적극적으로 난동행위에 대처하기 위해서는 단계별 대응 매뉴얼을 구체적으로 명시하고 이에 맞는 교육훈련을 강화해야한다. 또한 객실승무원의 채용요건을 무도단증과 수상인명구조원 자격 등 보안요원으로서 최소 요건을 채용응시자격으로 넣어 요건을 강화해야 한다. 마지막으로 항공기 내 보안요원은 전직 부사관 및 장교 출신 또는 경찰관 출신 등의 전문인력을 채용하여 고용의 재창출과 경력의 재사용을 통해 보다 안전한 항공기 운항을 도모할 수 있을 것이다.

영문 초록

Riots on board aircraft are unexpected behaviors and occur regardless of nationality, including international and domestic flights. Aircraft riot behavior is one of the dark aspects of air transport growth. Article 2 of the Aviation Security Act sets out standards for illegal activities along with terms. Typical causes of persistent in flight riots are alcohol and smoking on board and complaints about the quality of service. Accordingly, the Aviation Security Act, which aims to strengthen penalties for aircraft riots, has been revised and the level of penalties has increased, but increasing the sentence alone cannot be a fundamental solution. In other words, the biggest problem of the in-flight security personnel system, the lack of expertise of security personnel, the limitations of the duties and authority of the security personnel as a judicial police officer, and insufficient problems. Security officer training. It is necessary to specify step-by-step response manuals in detail and reinforce education and training accordingly to ensure the expertise of in-flight security personnel and enable the cabin crew to respond more actively to riots. In addition, it is necessary to strengthen the requirements by setting the minimum requirements for security personnel such as martial arts and lifeguard qualification as a recruitment qualification as a factor for recruiting cabin attendants. Finally, security personnel aboard the aircraft can employ former non-executive officers and specialized personnel such as police officers or police officers to promote safer flight operations through employment re-creation and career reuse.
