학생인권조례 시행이 학교의 인권환경 조성에 미치는 영향 분석

국문 초록

본 연구의 목적은 학생인권조례 시행이 학교의 인권환경 조성에 미치는 영향력을 분석하는 것이다. 이를 위해, 한국청소년정책연구원의 2019년 아동․청소년인권실태조사 자료를 활용하여, 학생인권조례 제정을 통해 기대했던 학교의 인권친화적 환경 조성과 인권침해적 환경 개선이라는 두 가지 측면에서 어떠한 영향을 미쳤는지를 실증적으로 분석하였다. 분석결과는 다음과 같다. 첫째, 학생인권조례 시행이 학교의 인권친화적 환경 조성에 미치는 영향은 없었지만, 학교의 인권침해 환경 개선에는 긍정적인 영향을 미쳤다. 둘째, 학생인권조례 시행은 학교의 인권침해 요소를 통계적으로 유의하게 감소시키는 것으로 나타났다. 셋째, 개인변인 중에서 자아존중감, 행복감, 인권보장인식 등 학생 개인의 심리적 특성은 인권친화적 학교환경에 긍정적인 영향을 미쳤고, 인권침해적 학교환경에는 부적인 영향을 미치는 것으로 나타났다. 넷째, 인권교육 경험도 인권친화적 학교 환경 조성과 인권침해 환경개선에 통계적으로 유의한 영향을 미치고 있었다. 마지막으로 지역사회 구성원들이 사회적 약자를 배려하고 포용적일수록 인권친화적 학교환경 조성이나 인권침해적 학교환경 개선에 긍정적인 영향을 미칠 수 있음을 보여주었다. 이러한 연구결과를 토대로 아동․청소년인권 증진과 보장을 위해서는 학교에서 배려와 존중의 문화를 확산할 수 있는 활동의 개발과 추진이 필요하고, 학생인권의 제도화 논의를 넘어 아동․청소년 인권을 주류화하기 위한 노력이 필요하다는 점을 제언하였다.

영문 초록

This study aims to analyze the effects of enforcement of ‘the Student Human Rights Ordinance’ on the making human rights environment in schools. For this purpose, I used the Korean Survey on the Rights of Children and Youth 2019 data, and analyzed the effects of the Student Human Rights Ordinance on the both of a promotion of human rights friendly environment and a reduction of human rights violation in schools with OLS and PSM regression. The results of the analysis are as follows. First, there was not statistically significant effect of the enforcement of the Student Human Rights Ordinance on the human rights friendly school environment. Second, the enforcement of the Student Human Rights Ordinance had statistically significant effect in reduction of the human rights violations in schools. Third, among the personal variables, students psychological characteristics, such as self-esteem, happiness, and awareness of guaranteeing human rights, had a statistically significant effect on the promotion of human rights friendly environment, and the reduction of human rights violation in schools. Fourth, students’ participating in human rights education had also statistically significant effect in both of the promotion of the promotion of human rights friendly environment, and the reduction of human rights violation in schools. Finally, it was shown that the more inclusive and caring for the vulnerable social groups in the local community, the more it can have a positive effect on the promotion of human rights friendly environment and reduction of human rights violation in schools. Based on these results, this study suggested that it is necessary to develop and promote activities that can spread a culture of caring and respect each other in schools, and to mainstream the human rights of children and adolescents beyond the institutionalization of student human rights.
