국문 초록

한비자의 정치이론은 유가와 대안적인 교육이론으로 해석될 수 있다. 한비자의 정치이론은 정치행위에는 필연적으로 인식의 변화가 수반될 수밖에 없으며, 그 변화는 곧 교육의 과정임을 보여준다. 한비자의 정치이론을 구성하는 두 가지 축인 정치행위론과 정치인식론 사이의 긴장관계는 그의 정치이론을 교육이론으로 해석하고자 할 때 가장 주목해야 할 부분이다. 한편으로 정치인식론은 정치행위론에 시사된 교육적 함의를 보다 직접적으로 드러내어 설명해 주지만, 다른 한편으로 정치행위론은 정치인식론에 결여된 도(道)의 지위와 성격을 보다 분명하게 규정해 준다. 한비자는, 유가의 지식교육과는 다른 관점에서, 일상생활의 행위규칙과 규범이 가지는 교육적 의미를 ‘법세술지사(法勢術之士)’의 행위와 인식을 통하여 드러내었다. 한비자의 사상에서 법세술지사는 특별한 집단에 국한되지만, 오늘날 그것은 일상적 삶을 영위하는 모든 인간이 따라야 할 하나의 교육적 모범으로 이해될 수 있다.

영문 초록

This study attempts to interprets Hanfei s legalist philosophy as educational theory by focusing on its proposition about Tao. In Hanfei s educational theory, Tao is the ultimate goal, regulating people s behavior, and eventually their mind. Tao is expressed in law(法), and the law involves political activities along with Shi(勢) and Shul(術). In the other hand, legalist s political epistemology is construed mainly by the concept of Hyungmung(形名). According to the theory of Hyungmung, the consistency of actual life is the final criteria of knowledge and truth. Hanfe s political epistemology is based on subtle balance between Tao and the consistency of actual life. In contrast with Confucian education, Hanfei s education is the process of following and practising laws, which enables to develop the people s mind and their morality. The so called gentlemen of 法勢術‘ should be understood in modern context as the model which everyone who lives everyday life could pursue. In conclusion, to interpret Hanfei s legalist philosophy as educational theory reveals the logical connection between the meaning of politics and the meaning of education.
