국문 초록

이 연구는 학생을 폭행했다는 사유로 학부모에게 고소당한 교사의 경험을 비판적 자문화기술지를 통해 분석하는 것을 목적으로 한다. 이 과정을 분석하기 위해 개인 기록자료와 성찰 노트, 다양한 기관의 공식 문서 등을 활용하였다. 연구자는 학생의 문제행동을 교육하려고 노력하는 과정에서 학부모에게 고소당했고, 이로 인해 그동안의 교육적 노력을 부정당하는 경험을 했다. 내러티브에 대한 비판적 분석 결과, 첫째, ‘교육의 사법화(judicialization of education)’ 현상이 일상화되었다. 오늘날 학교의 많은 활동은 교육적 정당성이 아니라 사회적 효율성과 절차적 합법성에 의해 이루어진다. 이것은 학생을 위한 교육적 노력보다 법률과 규정, 절차에 따른 해결을 우선하게 만든다. 둘째, 교육의 사법화는 학부모와 교사의 관계를 재구성한다. 일부 학부모는 교육 소비자로서 교육서비스를 요구하는 것을 넘어, 학교와 교사를 감시하고 통치하려고 한다. 이로 인해 많은 교사들은 자존감의 손실을 경험하며, 심한 경우 실존적 위기를 겪는다. 셋째, 교육의 사법화는 학생 교육을 교사 개인의 문제로 환원시킴으로써, 교사들을 각자도생하게 만든다. 이런 상황에서 교육공동체 담론은 공허한 수사에 머문다. 마지막으로 연구자는 교육이라는 이름으로 행했던 기존의 행위들을 성찰할 수 있었다. 학생, 학부모, 교사가 보편적 인권에 기반 하여 서로 신뢰하고 존중하며 교육할 수 있는 방안 모색이 필요하다.

영문 초록

This article aims to analyze experience of a teacher who was sued by parent using the critical autoethnography. As a teacher, I tried to correct my student’s problem behavior, but his parents sued me for physically assaulting my students. I wanted to share the meaning of this case with others using critical autoethnography. Autoethnography is form of qualitative inquiry intended to connect the lived experience of a researcher to the larger social and cultural context. Results of self-narrative analyses are below. First, teacher’s activities are increasingly dependent on the judgement of the law rather than educational judgement. Because of the judicialization of education, teachers tend to adhere to laws, regulations, and procedures rather than solving problems educationally. Second, the judicialization of education affected not only the behaviors of teachers but also the identity of students and parents. Some parents wanted to monitor school and control teachers overall, going beyond demanding educational services as education. Teachers suffered from violationof their authorties and faced their existential crisis. Third, the judicialization of education treated all problems as personal problems. Finally, this sued experience provided an opportunity to reflect on the way I have done in the name of education. Teachers, students, and parents need to develop sensitivity to universal human rights and mutual respects.
