국문 초록

역사적으로 화폐는 금속화폐에서 오늘날 지폐로 변천해왔다. 국가화폐인 지폐는 중앙은행을 중심으로 한 금융시스템을 통하여 공급되며, 통화와 신용의 핵심에서 가치기준을 제공한다. 국제거래에서는 주요국의 기축통화가 계약법적 기반에서 통용된다. 오늘날의 국가화폐는 자본주의 시장경제의 성장을 가능하게 하였으며, 국가권력의 확대에도 기여하였다. 화폐는 법제도적 측면뿐만 아니라 정책과 신뢰의 요소를 내포하고 있음으로 인하여 본질적으로 불안정하며, 전쟁이나 혁명 등으로 화폐질서가 붕괴되기도 한다. 통화정책에 따른 화폐가치의 변동은 국민의 재산권에 광범위한 영향을 미치며, 이는 헌법상의 재산권보장과 긴장관계를 이루고 그 한계가 문제된다. 화폐법이나 통화계약과 관련한 판례는 화폐에 관한 집단적인 관념의 변화를 반영하고 있다. 한 국가의 화폐로 표시된 채권·채무관계나 지급결제에서 명목주의 원칙이 적용되나, 개별적인 사안에 따라서는 불공정을 시정하기 위한 입법적·사법적 조치가 필요할 수 있다. 그 공정성은 화폐로 표현된 노동의 가치를 적절히 보장하는 것이어야 한다.

영문 초록

Historically, money has changed from metal currencies to today s notes. The state’s money is supplied through the banking system with the central bank on its center and provides the value standard of various currencies and credit. In international transactions, the key currencies of major countries are used on the contract basis. Today s fiat money has supported the growth of the capitalist market economy and has contributed to the expansion of state power. Money is intrinsically unstable because it contains elements of policy and trust as well as legal institutional aspects, and the money system has occasionally collapsed due to war or revolution. The change of money’s value by the currency policy has a wide range of impacts on the property rights of the people, which is in tension with fundamental rights guaranteed by the Constitution. The judgment of courts relating to monetary law and currency contracts reflects changes in the people’s collective vision of money. The principle of nominalism applies to credit-debt relations and payment-settlements that are denominated in a state’s currency, but individual cases may require legislative and judicial adjustment to correct unfairness. The fairness should ensure that the value of labor expressed in money is adequately protected.
