노후 공동주택 CPTED 고도화 지원을 위한 입법 방향에 관한 연구

국문 초록

근 5년 이내 신축된 공동주택을 보면 주동 출입구와 각 세대 현관문에 출입 통제시설과 CCTV 등이 다수 설치되어 있다. 또한 관련 기술의 발달로 대부분 LED 조명이 설치되어 전기료 절감과 함께 유지관리에도 편리성을 높이고 있다. CPTED 측면에서 이러한 부분을 바라본다면, 100점은 아니더라도 충분히 기본은 갖추고 있다고 평가할 수 있다. 그러나 기존 20년 이상 지난 구축 공동주택의 경우에는 거주자나 관리사무소 등의 관심과 의지에 따라 범죄예방을 위한 각종 시설의 설치와 교체 등 유지관리에 현격한 차이가 발생하고 있다. 이러한 문제를 개선하기 위한 법과 정책적 지원은 거의 없다. 그리고 과태료 등 행정벌로 이러한 유지관리를 강제할 법적인 수단도 없다. 더군다나 서울시에서도 지역마다 공동주택의 노후화가 차이를 보이는 상황에서, 저출산과 고령화로 지방의 경우 이러한 문제를 개선하기 위한 자체적인 노력을 기대하기 어려운 상황이 되어 가고 있다. 재건축이나 재개발에 대한 법과 정책은 있지만, 이는 지역에 따라 현격한 격차가 나타나므로 사실상 불가능한 지역도 많다. 일정한 지역의 공동주택이 사적인 영역이라는 이유로 방치되면, 인근 지역까지 범죄의 취약성이 나타날 수 있다. 이를 경찰의 순찰 활동만으로 극복하기는 어렵다. 따라서 지역사회에서 일정한 협의체를 구성하여 이를 지원하는 방안이 마련되어야 한다. 누구나 범죄로부터 평균적으로 안전한 공간에서 거주할 수 있도록 조속히 법과 정책이 마련될 필요가 있다.

영문 초록

In the case of newly built apartment complexes in the past 5 years, many access control facilities and CCTVs are installed at the main entrance and the front door of each household. In addition, with the development of lighting technology, most are equipped with LED lights, which reduces electricity costs and improves convenience in maintenance. Although it may not be 100 points from a CPTED perspective, it is sufficiently equipped with the basics. However, in the case of existing apartment complexes built over 20 years ago, there is a significant difference in maintenance management such as installation and replacement of various facilities for crime prevention depending on the interest and will of residents or management offices. This is because there is almost no legal or policy support to improve these problems. On the other hand, there is no legal means to enforce such maintenance management through administrative penalties. Furthermore, in Seoul, the aging of apartment complexes varies by region, and it is becoming difficult to expect local areas to make their own efforts to improve these problems due to low birth rates and aging populations. Although there are laws and policies for reconstruction and redevelopment, these differ significantly by region, making them virtually impossible in many areas. If apartment complexes in a certain area are left unattended because they are private, crime vulnerabilities may appear in nearby areas. It is difficult to overcome this with police patrols alone. Therefore, a plan should be prepared to support this by forming a certain consultative body in the local community. Laws and policies need to be established as soon as possible so that everyone can live in a space that is on average safe from crime.
