컨테이너보험약관의 법해석론적 고찰

국문 초록

컨테이너보험은 컨테이너보험계약에 의하여 실현되는데, 컨테이너보험계약은 보험자가 미리 작성한 컨테이너보험계약의 내용을 피보험자인 컨테이너소유자가 사실상 포괄적으로 받아들여서 계약이 체결되는 일종의 부합계약의 성격을 가진다. 컨테이너보험계약에서 사용되는 정형화된 계약내용을 인쇄문구로 나타낸 조항을 총칭하여 컨테이너보험약관이라고 한다. 현재 전 세계적으로영국의 런던보험자협회(Institute of London Underwriters : ILU)에서 제정한협회컨테이너보험약관(Institute Container Clauses-Time)이 컨테이너보험계약의 표준약관 또는 기본약관으로 가장 많이 사용하고 있다. 이와 같이 영국에서 제정한 협회컨테이너보험약관을 사용하기 때문에 컨테이너보험과 관련한 법률 문제 또한 영국의 법률과 관습에 따라 해결할 수밖에 없다. 그러나 협회컨테이너보험약관에서 실제 사용되는 언어가 영어이기 때문에 협회컨테이너보험약관의 내용을 정확하게 번역하기가 곤란하며, 설사 번역한다고 하더라도 각 약관의 법적 의미 및 내용을 이해하는 데는 한계가 있다. 또한 현재 국내에서 컨테이너보험을 다룬 논문 및 서적 등이 전무한 상태이며, 최근에는 컨테이너 금융활성화의 일환으로 컨테이너보험의 활용을 제시하고 있다. 따라서 이 논문에서는 컨테이너보험실무 담당자가 쉽게 이해하고 접할 수 있는 중요자료를 제공하기 위하여 협회컨테이너보험약관의 주요 내용을 법해석론적으로 고찰하고자한다.

영문 초록

Container insurance is effectuated by a container insurance contract. A container insurance contract is a kind of adhesion contract in which an insurer prepares an container insurance contract in advance and the insured who is the assured admits the terms comprehensively. Clauses of the container insurance are a printed form of provisions representing the typical contents used in container insurance contracts. At present, the Institute Container Clauses-Time, which is introduced by the Institute of London Underwriters in the UK, are widely used as standard clauses for container insurance contracts. Since the Institute Container Clauses-Time is based on the British law, legal matters related to container insurance contracts in may cases have to be resolved according to English law and practice. However, the Institute Container Clauses-Time is written in English and, therefore, it is hard to be translated accurately and even if they are translated accurately, there may be a limitation in understanding the legal meanings and contents of each clause. Additionally, research papers or academic books dealing with matters of container insurance are not common in Korea. Meanwhile, the use of container insurance has been proposed recently as a part of the revitalization of container fiance market. Thus, in order to provide materials easily understandable and accessible to those in charge of container insurance, this study examines major contents of the Institute Container Clauses-Time and container insurance contracts on the basis of legal interpretation.
