국문 초록

2017년 6월 『6·25전쟁 납북피해 진상보고서』 발표 이후 6·25전쟁 납북자 문제에 대한 관심은 현저히 줄어들었다. 이런 상황에서 전쟁납북자 가족들에 대한 구제조치(의료지원금, 생활지원금, 보상금 등)는전혀 이루어지지 못하고 있다. 이는 전후납북자들이나 제주4·3사건 피해자 등 다른 과거사 피해자들과의 형평성을 고려할 때 심히 부당한 처사이다. 이 점을 고려할 때 조속히 전시납북자법을 개정하여 전쟁납북피해자들을 위한 형평적 해결과 단계적 해결을 도모할 필요가 있다. 여기서 단계적 해결이라 함은 우선 6·25전쟁납북진상규명위원회에 신고하여 전시납북자 결정서를 통보받은 4,777명에 대해 피해구제를 실시하고, 나머지 9만 1천여 명에 대해서는 추후에 진상규명 활동을 재개하여 피해구제를 하자는 것을 의미한다. 이론상 강제실종방지협약 이행법률 제정방안, 과거사정리법 개정 및 별도의 보상법 제정방안도 고려할 수 있으나, 필자는 실현가능성이 낮다고 판단하였다.

영문 초록

Since the announcement of the “Fact-finding Report on the Damage from North Korea's Abduction during the Korean War” in June 2017, interests in the Korean War Abductees issue have significantly grown less. In this situation, no relief measures (medical assistance, living assistance, compensation, etc.) have been implemented for the families of war abductees. This is very unfair considering the equity with other victims of the past wrongdoings, such as victims of post-Korean war abduction perpetrated by North Korea and victims of the Jeju April 3 Incident. Considering this, it is necessary to revise the present “Act on Finding the Truth of the Damage from North Korea’s Abduction during the Korean War and Restoring Honor of the Victims(Wartime Abductees Act)” as soon as possible to promote an equitable and phased solution for victims of wartime kidnapping. Step-by-step solution or managing here means that 4,777 people who were already notified of a written decision about the wartime abduction by submitting reports to the Korean War Abduction Fact-finding Committee and resuming fact-finding activities later after that relief measures to remedy the damage of the other victims of wartime abduction. Besides, in theory, it is possible to consider a plan either to enact a new law to implement “International Convention for the Protection of All Persons from Enforced Disappearance(the so-called Enforced Disappearance Prevention Convention)” or to amend the existing “Framework Act for the Settlemet of Past Wrongdoings” of 2005, and enact a separate law on the compensation for the victims of those past affairs. But the author thinks that such alternatives are unlikely to be realized.
