메타버스 저작권 가이드라인 제정을 위한 시론적 연구

국문 초록

메타버스 산업에 대한 성장 기대에 비해 법제도 정비가 더디다. 학계에서는 ‘메타버스저작권 가이드라인’ 마련이 시급하다는 문제 제기가 있어 왔다. 본고는 이를 위한 시론적 연구(試論的 硏究)로, 실제 메타버스 서비스의 현황을 분석하면서 핵심 주제를 발굴하고 방향성･시사점을 제언하고자 하였다. 먼저 현실과 제도의 간극을 이른바 일반규정 혹은 개방적 규정(open-ended clause) 이 메워줄 수 있을 것으로 기대되는 현실에서, 공정이용 일반조항의 사법적 운영 현황을분석하여 변형적 이용, 영리성･시장 대체성, 출처 명시 등을 가이드라인에서 고려할 주요 키워드로 제시하였다. 다음으로 권리 처리 실무를 가이드라인에 반영할 것을 요청하면서 주요 사업자의 약관을 분석하였다. 포괄적 이용허락이나 과도한 면책조항 등은 약관법에 위배될 우려가 있음을 지적하였으며, 실무상 계약 관행이더라도 불공정한 내용이 그대로 가이드라인에 반영되지 않도록 주의할 것을 당부하였다. 마지막으로 한국저작권위원회 상담센터의 로데이터(raw data)를 분석하여 가이드라인에서 우선적으로 다룰 저작권 현안을 도출하였다. 저작권 가이드라인이 하루아침에 만들어질 수는 없다. 후속연구로 이어져 지속가능한 상생의 균형점을 제시하길 기대한다.

영문 초록

For some time now, academics have raised the issue of the urgency of establishing ‘Guidelines for Metaverse Copyright’. Recently, the government has also considered enacting guidelines as a policy matter. This paper conducts a pilot study that identifies issues, summarizes implications, and suggests directions for future discussions. The current copyright law does not address the challenges posed by the metaverse environment. Fair use provisions in the form of so-called general or open-ended clauses can fill this gap. This paper analyzed the current state of judicial practice of general fair use clauses and identified important keywords such as transformative use, profitability, market substitution, and credit attribution. Subsequently, the terms and conditions of major service providers were reviewed, aiming to incorporate their rights handling practices into the guidelines. It was noted that blanket licenses for UGC and excessive exemptions, which have been practiced in the past, may be considered as unfair terms and conditions. Further, this paper analyzes raw data from the Korea Copyright Commission’s consultation center to investigate public interests in metaverse copyright and identify issues by subject. Copyright guidelines don’t emerge overnight. Hopefully, this pilot study will lead to in-depth research and suggest a sustainable win-win balance.
