저작인격권으로서 동일성유지권의 해석론에 관한 소고

국문 초록

우리 저작권법 제정 당시 동일성유지권은 원상유지권과 변경권으로 규정되어 있었으며, 원상유지권의 경우 그 침해 요건으로 저작물의 변경에 더하여 명예와 성망의 훼손이요구되었다. 그러나 법률 개정을 통하여 원상유지권과 변경권이 동일성유지권으로 통합되었고, 그 과정에서 명예와 성망의 훼손이라는 요건이 삭제되었다. 그러나 동일성유지권 규정에서 저작자의 명예와 성망의 훼손이라는 요건이 삭제됨으로 인해 동일성유지권의 권리 범위가 넓어지고 강력해지게 되었고, 이로 인해 저작자가자신의 인격적 이익 보호보다 경제적 이익을 위하여 동일성유지권을 활용하는 사례가증가하게 되었다. 이러한 상황에서 우리 법원은 동일성유지권을 부정할 필요가 있는 경우에 명문의 해석론을 전개하기보다는 묵시적 동의 또는 이용허락을 받았다는 점 등을근거로 동일성유지권 침해를 부정하여 왔다. 그러던 중 미리듣기 사건Ⅱ를 계기로 동일성유지권 침해 여부에 관한 우리 법원의 판단에 변화가 생기기 시작하였다. 미리듣기 사건Ⅱ에서 우리 법원은 저작물의 내용이나형식이 오인될 우려가 없는 경우에는 동일성유지권 침해에 해당하지 않는다고 판단하였다. 그리고 이러한 변화의 흐름은 프로야구 응원가 사건에서도 계속해서 이어졌다. 동일성유지권 침해 여부 판단에 대한 우리 법원의 이러한 태도 변화는 저작물의 원활한 이용에 있어 분명히 긍정적 요소로 작용할 수 있는 부분이다. 이처럼 해석론 전개를 통하여 동일성유지권 침해를 부정하기 시작하였다는 긍정적 변화가 있기는 하나, 여전히 명확한 해석론은 제시되지 못하고 있다고 생각된다. 이에, 저작자의 인격적 이익 보호와 저작물의 원활한 이용 사이에 완벽한 균형점을 찾기 위해서는 동일성유지권에 대한 보다 명확한 해석론이 제시될 필요가 있다고 보여진다.

영문 초록

At the time of the enactment of the Korean Copyright Act, the right of integrity was stipulated as the right to maintain the original state and the right to change. In the case of the right to maintain the original state, in addition to the change, damage to honor and reputation was required as a requirement for infringement. However, through the revision of the law, the right to maintain the original state and the right to change were integrated into the right of integrity. In the process of revision, the requirements for damage to honor and reputation were deleted. However, as the requirements for undermining the author’s honor and reputation were removed, the scope of the right of integrity became wider and stronger, and it became a problem in the process of using the work. Even the right of integrity was claimed for economic benefits rather than the protection of personal right. Based on this legal structure, court has denied infringement of the right of integrity on the grounds of implied consent rather than the development of the interpretation theory of the copyright law inscription when it is necessary to deny the right of integrity. In the meantime, in the wake of the case pre-listening case II, a judgment began to be issued that the infringement of the right of integrity of the work was denied even in matters previously recognized as damage to the identity of the work, such as extracting and using part of the work without implied consent or the author’s consent. However, despite these changes, it can be said that court still has not been able to provide a clear interpretation of the reason why infringement of the right of integrity can be denied. Therefore, court should pursue a balance between the convenience of using the work and the protection of the author’s personal value or interest, and a clearer interpretation theory should be presented so that the use of other types of works other than musical works can be clearly determined and predicted.
