국문 초록

연구목적: 본 논문은 한중 FTA 협정하의 국경 간 전자상거래(CBEC)의 성과 및 한계를 평가하고, 여타 관련 협정 내 조항과의 비교분석을 통해 현 조항의 한계를 분석하며, 양국간 협력을 강화하기 위한 제안을 하였다. 또한, 급격히 발전하는 글로벌 디지털 무역 시대에서 한중 FTA 협정 및 전자상거래 관련 조항을 정비하기 위한 한중 FTA 협정 제2단계 협상의 필요성 및 이에 대한 협력을 강조하였다. 논문구성/논리: 본 논문은 한중 FTA 정식 시행 후 양자간 국경 간 전자상거래 발전에 대한 종합적 분석을 통해, 양국간 전자상거래의 교역, 결제방식, 물류 현황, 통관 규제, 양국 정부 간 협력 등 문제를 다뤘다. 특히, 알리익스프레스에 대한 사례 분석을 통해 한국 CBEC 플랫폼이 중국 시장 확대를 위한 전략과 시사점을 제공했다. 또한, 한중 FTA의 국경 간 전자상거래 조항과 관련해 새롭게 제기되는 국제적 규제 혹은 협정들을 비교 분석하여 현 한계점과 향후 협력 가능성을 토론하고, 이 분야에서의 발전 방향을 제시하였다. 결과: 팬데믹이란 큰 충격이 발생하였음에도, 한중 양국간 국경 간 전자상거래 규모는 약 네 배 증가하여 전체 양국 간 거래 건수의 절반을 차지하였다. 더불어, 한중 FTA는 제품 및 서비스, 결제방식, 물류, 관련 초국경 전자상거래 플랫폼 등 영역에서의 다양성과 혁신성을 제공하였다. 하지만, 한중 FTA 협정 내 '전자상거래' 관련 조항을 기반으로 한 연구는 국경 간 데이터의 흐름, 소비자 보호 등 관련 조항의 제약으로 인해 한중 디지털 무역 발전을 저해하는 요인이 되고 있음을 발견하였다. 독창성/가치: 본 논문은 한중 FTA 협정 하의 한중 국경 간 전자상거래에 관한 선행연구를 확장하고 있다. 특히 사례 분석을 통해, 한국과 연관된 국경 간 전자상거래 기업이 중국 시장에 진출하기 위한 전략적 방향성을 제공했다. 또한, 동 연구는 다른 무역 규범을 기반으로 한중 FTA 제2단계 협상의 필요성과 글로벌 디지털 경제 트렌드에 따른 양국 간 디지털 무역 협력을 강화할 것을 제안하였다.

영문 초록

Purpose: This study assesses the Cross-Border E-Commerce(CBEC) outcomes within the Korea-China Free Trade Agreement(FTA), comparing its terms with other agreements to identify constraints and propose enhancements for bilateral cooperation. It emphasizes the significance of facilitating the Second-Phase FTA Negotiations to align with the rapidly evolving global digital commerce sector. Composition/Logic: The study offers a comprehensive analysis of bilateral CBEC development since the FTA’s implementation, encompassing aspects such as trade volume, logistics, payment method, customs regulatory, and inter-governmental cooperation. Particularly, the learning from an AliExpress case study is employed to illustrate strategic opportunities for Korean CBEC platforms in the Chinese market. Moreover, the comparative analysis of the FTA’s CBEC terms with emerging international agreements highlights existing gaps and potential areas for enhanced cooperation, which identify the development direction in this field. Findings: Despite challenges posed by the COVID-19 pandemic, bilateral CBEC trade has quadrupled, comprising over half the total number of bilateral transaction cases. Furthermore, the FTA has fostered diversification and innovation in products, services, payment methods, logistics, and associated CBEC platforms. However, based on the “E-commerce” chapter of the China-Korea FTA, the study also reveals significant challenges impeding China and Korea’s digital trade and economic prosperity in the global digital economy. Predominantly, these barriers are rooted in the inadequacy of provisions on cross-border data flows, consumer protection, and etc. Originality/Value: This study addresses a crucial gap in the literature on the Korea-China bilateral CBEC within the context of their FTA. Applying a case study approach, it offers strategic insights for Korean enterprises aiming to penetrate the Chinese market. Additionally, it advocates for stronger bilateral digital trade cooperation in the context of forthcoming Second-Phase FTA Negotiations, aligning with global digital economic trends.
