국문 초록

민법 제367조는 저당권의 제3취득자가 목적물에 비용을 제출한 경우 경매대가에서 상환받을 권리를 인정한다. 이 규정은 일본민법 제391조를 거쳐 개정 전 프랑스민법 제2175조로 소급한다. 이 규정의 비용상환청구권은 제3취득자가 비용을 지출한 경우 저당권자가 부당이득을 한다는 관념에 기초하고 있다. 이 규정의 비용상환청구권은 위 법전들 특유의 것이기는 하나 독일, 미국 등 다른 나라에서도 다소 비슷한 쟁점 또는 관념을 찾아볼 수 있다. 주목할 점은 일본과 프랑스 모두에서 이 권리의 실현을 강화함과 동시에 이를 경매대가에서 우선변제받는 것으로 제한하는 방향의 발전이 보인다는 사실이다. 즉, 저당 목적물의 제3취득자는 우선변제를 받지 아니한 채 경매 후 그에 대한 유치권을 원용하여 그 매수인에게 그 인도를 거절할 수는 없다. 이러한 접근은 우리 법에서도 타당하다고 보인다.

영문 초록

Article 367 of the Korean Civil Code stipulates that the purchaser of mortgaged property shall be reimbursed from the proceeds of judicial sale thereof when he or she made improvements thereon. This provision has its root in Article 391 of the Japanese Civil Code, which, in turn, is under the influence of Article 2175 of the French Civil Code of 1804. The right to reimbursement of the purchaser of the mortgaged property, in this case, is based on the idea of unjust enrichment of the mortgaged by the purchaser who made the improvements. Although the right to reimbursement of the purchaser of the mortgaged property, in this case, is unique to the above Codes, a somewhat similar issue or idea can be found in other jurisdictions like Germany or the United States. One thing notable is that we can observe a line of development in Japan as well as France that the way to realize this right has reinforced as well as limited to the right to distract the reimbursement from the proceeds of judicial sale. Consequently, the purchaser of mortgaged property cannot resort to the right to retention thereon by rejecting to hand it over after the judicial sale process has been closed without distraction because he or she did not assert the distraction of reimbursement. This approach should be favored in Korean law, too.
