국문 초록

스토킹은 대부분 남성이 여성에 대해 행하는 성별적인 행위이며 친밀성의 맥락에서 발생하는 경우가 많다는 점에서 스토킹을 젠더기반폭력으로서 친밀한 파트너 폭력(IPV)의 맥락에서 접근할 필요성이 있다. 그러나 한국의 스토킹처벌법은 젠더기반폭력으로서의 성질과 친밀성이 반영되지 못한 채 제정되어 사건 대응과 피해자 보호에 모순과 허점을 남기고 있다. 이 논문은 친밀한 파트너 스토킹에 대한 외국의 선행연구를 분석하여 친밀한 파트너 스토킹의 강압적 통제로서의 성질과 다른 관계 유형의 스토킹에 비해 친밀한 파트너 스토킹이 갖는 특성을 살피고, 친밀한 파트너 스토킹의 측면에서 스토킹 대응의 법, 정책적 개선 방안을 모색하고자 하였다. 젠더기반폭력으로서의 강압적 통제는 여성의 신체적 완전성을 침해하고 자율성을 부정하고 고립시키며 자원 접근성을 제한하여 여성을 타인의 의지에 종속시키는 악의적인 행동 과정을 수반하는 행위이다. 강압적 통제 이론에서 스토킹은 대인 관계라는 자신의 욕구를 충족하기 위하여 상대방의 생활을 침해하여 자율성을 통제하는 행동으로, 강압적 통제 이론은 젠더 권력 관계가 스토킹을 정상화하고 독려하는 양상을 이해하는 데 도움을 준다. 또한 스토킹에서 친밀성이라는 관계 특성은 독특한 가해와 피해를 만들어낸다. 친밀한 파트너 스토킹은 당사자들이 형성해온 관계 이력의 맥락에서 발생하여 다른 유형의 스토킹과는 구분되는 위협과 공포를 가능하게 하며 피해자의 사적 정보와 취약점, 인적 관계를 스토커가 더 쉽게 활용할 수 있어 스토킹 방법이 더욱 다양해지며 피해자의 대응은 어렵고 위험성은 높은 반면, 형사사법적 대응과 피해자 보호에서는 더 관대하게 처리될 가능성이 높은 것으로 나타난다. 이와 같은 친밀한 파트너 스토킹의 특성을 반영하기 위해서는 스토킹을 구성하는 개별 사건들보다도 일련의 사건들의 패턴과 행위 과정, 당사자의 관계성과 성별 권력 관계의 맥락 속에서 강압적 통제로서의 행위의 성질을 파악하고 대응할 수 있도록 하여야 하며, 스토킹이 당사자 간의 공유되는 관계를 통해 제3자까지 확장되는 문제를 포괄할 수 있어야 한다. 또한 친밀성의 맥락에서 피해자의 상황에 부합하는 피해자 보호, 지원이 가능하도록 할 것이 요청되며, 이를 위하여, 수사, 재판, 피해자 지원 담당자의 교육, 판단 지침, 스토킹 관련 법률 등의 정비가 이루어져야 한다.

영문 초록

Stalking is mostly a gendered behavior perpetrated by men against women and often occurs in the context of intimacy. As such, it is necessary to approach stalking in the context of intimate partner violence (IPV) as a gender-based violence. However, stalking law has been enacted without reflecting gender and intimacy, leaving contradictions and flaws in case response and victim protection. This paper analyzes foreign studies on intimate partner stalking to examine the nature of intimate partner stalking as coercive control and the characteristics of intimate partner stalking compared to stalking in other relationship types, and to explore ways to improve laws and policies in response to intimate partner stalking. Coercive control as a gender-based violence involves a malicious course of action that violates women’s bodily integrity, denies them autonomy, isolates them, limits their access to resources, and subordinates them to the will of others. In coercive control theory, stalking is an act of controlling autonomy by invading another person’s life to satisfy one’s own needs for interpersonal connection, and coercive control theory helps us understand how gendered power relations normalize and encourage stalking. In addition, the relationship characteristic of intimacy in stalking creates unique perpetration and harm. Intimate partner stalking occurs in the context of the parties’ relationship history, which enables threats and fears that are distinct from other types of stalking; the victim’s private information, vulnerabilities, and relationships are more readily available to the stalker, resulting in a greater variety of stalking methods, the victim’s response is more difficult and the risk of stalking is higher and the criminal justice response and victim protection are likely to be more lenient. To reflect these characteristics of intimate partner stalking, it is important to recognize and respond to the pattern and course of conduct of a series of events rather than the individual incidents that constitute stalking, the nature of the behavior as coercive control within the context of the parties’ relationship and gender power relations, and the extension of stalking to third parties through the shared relationship between the parties. It is also called for to ensure that victim protection and assistance is tailored to the victim’s situation in the context of intimacy. To this end, training for law enforcement, judges, and victim support workers, judgmental guidelines, and stalking laws should be developed.
