성인지감수성과 성적 불쾌감 표현이 성폭력범죄 판단에 미치는 영향

국문 초록

최근 성폭력범죄에 대한 사법적 판단에 있어 두가지 주요한 변화가 생겨났다. 첫째, ‘성인지감수성’을 성범죄 사건의 판단에 중요한 고려사항으로 수용한 것이고, 둘째, 양형기준에서 ‘성적 수치심’이라는 양형인자가 ‘성적 불쾌감’으로 변경되었다. 이러한 변화는 성폭력범죄 판단 시 피해자의 관점을 적극 고려함으로써 성범죄 피해자에 대한 편견을 최소화하고, 피해자의 주관적인 감정을 양형에 적극적으로 반영하기 위함이다. 그럼에도 불구하고 이들 용어의 정의가 불분명하다는 비판이 있기 때문에, 사법판단과정에서 해당 개념을 반복해서 상기시키는 방법을 주로 적용하고 있다. 그러나 이러한 용어의 변화와 적용방식이 실제로 개인의 인식과 의사결정에 어떤 영향을 주는지에 대한 실증적인 연구는 이루어지지 않고 있다. 본 연구는 성인지감수성과 성적 불쾌감의 표현을 상기시키는 경우 범죄판단에 어떤 차이가 발생하는지를 살펴보기 위해 일반인 221명, 경찰관 176명을 대상으로 설문조사연구를 실시했다. 연구결과 성인지감수성이나 성적 불쾌감 판단기준에 대해 상기시키는 효과는 제한적으로 나타났다. 성인지감수성 기준이 단독으로 제시된 경우보다 성적 불쾌감과 함께 제시된 경우 피험자들의 피해자에 대한 비난이 낮아졌지만, 용어의 표현에 따른 판단 차이는 제한적이었다. 반면 참여자의 지위와 성별에 따른 판단의 차이가 더 두드러졌다. 경찰관은 일반인에 비해, 여성은 남성에 비해 피고인에 대한 비난가능성을 높게 보고, 엄격한 판결을 내리려는 경향이 강했다. 본 연구는 성인지감수성이라는 판단기준과 성적 불쾌감이라는 법률적인 용어를 명시적으로 상기시키는 방법이 대상자의 판단 변화에 큰 영향을 미치지 않음을 실증적으로 검토하였으며, 용어의 표현이 보다 더 구체화되고 명확히 정의되어야할 필요가 있음을 논의하였다.

영문 초록

Recently, the judicial approach to sexual violence crimes has undergone two changes. The concept of “gender sensitivity” has been included as an important factor to be considered in the judgment of sexual offenses, and the factor of “sexual discomfort” has been changed from a quantitative factor to “sexual discomfort” in the sentencing criteria. These changes aim to minimize bias against sexual assault victims by taking the victim's perspective into account in the judgment of sexual violence crimes and reflecting the victim's emotions in sentencing. However, some criticisms exist about the unclear definitions of these terms, and the method mainly applied in the judicial judgment process is to repeatedly recall these concepts. There is a lack of empirical research on how these changes and application methods affect individuals' perception and decision-making. A survey was conducted among 221 civilians and 176 police officers to examine the differences in criminal judgment when reminded of gender sensitivity and sexual discomfort. The study found that reminding individuals about gender sensitivity and sexual discomfort had a limited effect on their judgment. The difference in judgment due to the expression of the terms was minimal, but the criticism of the victim decreased when sexual discomfort was presented along with gender sensitivity, compared to when only gender sensitivity was presented. On the other hand, there were more significant differences in judgment based on the participant's status and gender. Police officers were more likely to criticize the defendant and give stricter sentences than civilians, and women were more likely to criticize the defendant than men. This study examined the effect of reminding individuals of the judgment standard of gender sensitivity and the legal term of sexual discomfort on their judgment and found that it had little effect. The study also highlighted the need for a more concrete and clear definition of these terms.
