공직자윤리법상 공직부패 방지에 대한 고찰

국문 초록

공직 사회의 부패는 사회의 각 영역에 큰 영향을 미치는 각종 법령을 제정하고 이를 집행하고 시행하는 공적영역에서 발생하는 점에서 공정한 경쟁원리 및 시장의 건전성을 해하고 공공에 대한 국민의 신뢰를 깨트림으로써 궁극적로는 우리 헌법상 기본원리인 법치주의 원리를 포함한 헌법상 기본적인 원리와 가치를 침해한다. 공직윤리로서 청렴성은 공직자가 지녀야 하는 도덕성의 기준으로서 공직자의 행위준칙이고 헌법 제46조 제1항의 국회의원의 청렴의무는 국회의원을 넘어서서 모든 공직자에게도 적용되는 의무이다. 공직자윤리법상 재산등록 및 공개제도는 공직자가 재산을 형성하는 방법이나 재산 보유의 한도를 규율하는 것이 아니라 형성된 재산을 국가에 신고하여 등록케 하는 방법이므로 헌법에 위반되지 않는다. 주식은 개인의 인격발현에 대하여 지니는 의미는 상당히 미소한데 반하여 사회적 연관성이나 사회적 기능이 뚜렷하므로 국가에 의하여 보다 폭넓게 제한될 수 있는 재산권이다. 주식백지신탁은 공무원과 가족간의 실질적 관련성에 의한 것이므로 헌법상 금지되는 연좌제에 해당되지 않는다. 퇴직공직자의 취업제한은 퇴직 이후 재취업한 특정 업체를 위해 재직 중에 취득한 기밀이나 정보를 이용하거나, 재직했던 부서에 대하여 부당한 영향력을 행사할 가능성을 사전에 방지함으로써 궁극적으로 직무의 공정성을 확보하기 위함이다.

영문 초록

Corruption in the public service society undermines the principle of fair competition and the health of the market, undermines the public's trust in the public, and ultimately violates the basic principles and values of the Constitution, including the principle of the rule of law, which is a fundamental principle of our Constitution. As a public service ethics, integrity is a standard of morality that public officials should have, and the duty of integrity of a member of the National Assembly under Article 46(1) of the Constitution is a duty that applies to all public officials beyond the members of the National Assembly. Under the Ethics of Public Officials Act, the system of property registration and disclosure does not violate the Constitution because it does not regulate how public officials form property or the limits on property holdings, but rather requires them to register the formed property by declaring it to the state. Stocks are property rights that have a fairly small meaning for the individual's personality manifestation, but because their social associations and social functions are distinct, they can be more broadly restricted by the state. Because a stock trust is based on a substantial connection between a public official and a family member, it does not fall under the constitutionally prohibited association system. The employment restriction of retired public officials is intended to ultimately ensure the fairness of their duties by preventing the possibility of using confidential information or information obtained during their employment for certain companies re-employed after retirement, or exerting undue influence over the department in which they were employed.
