갱생보호법의 독립적 입법에 관한 재논의

국문 초록

보호관찰과 갱생보호는 서로 다른 목적으로 행하여지는 국가작용이다. 전자는 출소자의 감시에 초점을 맞추는 반면 후자는 출소자의 사회복귀와 사회정착을 목표로 한다. 그런데 우리나라의 경우 보호관찰 등에 관한 법률에서서로 성격이 다른 보호관찰과 갱생보호를 한데 묶어 규정하고 있다. 이는 법명으로 보아 보호관찰이 출소자 대책의 핵심이고, 갱생보호는 보호관찰을 보호하는 일에 머물러야만 한다는 것으로 읽힌다. 그러나 세계적으로갱생보호활동이 점점 중요해지는 것이 근래의 추세이다. 갱생보호가 보호관찰의 하위개념이라거나 갱생보호는 보호관찰을 방해하지 않는 선에서만 허용된다는 인식은 바람직하지 않다. 이에 이 논문에서는 다른 나라의 갱생보호 시스템을 간략히 살피고 우리나라의 옛 갱생보호법 및 보호관찰법의 내용도 검토한 다음, 현재의 법체계에 대해 비판적으로 고찰하여 보기로 한다. 특히 갱생보호에 관한 입법안도발의된 지금에 있어, 이 글이 조금이나마 올바른 출소 후 재밤방지에 도움이되었으면 하는 바람이다.

영문 초록

Both probation and rehabilitation are state-working with different purposes. The former focuses on the surveillance of ex-prisoners, while the latter intends to promote social reintegration and resettlement of them. However, Korean Act on Probation does not distinguish between probation and rehabilitation, which have different characteristics. The name of this Act is interpreted that probation is the key of ex-prisoner management and rehabilitation is assisting probation. However, the recent global trend is the increasing importance of rehabilitation activities. Those awareness that rehabilitation is a sub-concept of probation, or that rehabilitation is permitted only when it does not interfere with probation are not desirable. The purpose of this study was, therefore, to briefly examines the rehabilitation system of other countries, review the Korean old rehabilitation and probation laws, and critically discuss the current legal system. In particular, given that the law on rehabilitation has been proposed, it is hoped that this study contribute to the correct system for recidivism prevention of ex-prisoners.
