국문 초록

강원특별자치도의 설치는 강원도의 지리적, 역사적, 인문적 특성을 고려한 차등분권의 논리에 따른 것이라 할 수 있다. 강원특별법은 대통령선거와 지방선거를 앞두고 정치적 타협에 의하여 급조되었다는 인식이 강하다. 23조와 부칙으로 구성된 특별법의 구조적인 문제점을 극복하는 것이 시급히 요청되고 있다. 강원도는 산악지대가 많고 군사보호구역과 수질보호구역 등 광범위한 규제를 받고 있기 때문에 개발 자체가 어렵고 경제적으로 낙후될 수밖에 없는 구조적 취약성을 가지고 있다. 다른 한편 강원도는 분단을 몸소 체험하고 있는 접경지대가 상당한 면적을 차지하고 있다. 그러므로 특별자치도로서 강원도를 자리매김하기위해서는 전쟁과 분단, 갈등을 넘어 화해와 평화의 시대로 가는 상징적인 의미를 살려내야 한다. 또한 2019년 강원도 일대가 유네스코 생물권보존지역으로 지정됨으로써 생태환경보존지역의 의미가 매우 크다는 점도 고려해야 한다. 이러한 점들을 고려한다면 강원특별자치도는 ‘국제 평화․생태환경도시’로서 정체성을 충분히 가지고 있으며 국제 평화․생태환경도시를 친환경적이고 모범적으로 개발하여 세계인들의 관심을 끌만한 지역으로 탈바꿈할 수 있는 훌륭한 동기부여가 가능하다. 이러한 강원도만의 특성을 살려 강원특별자치도의 실질적인 지방분권을 실현할 수 있으려면 강원특별법의 전면적인 수정보완이 필요하다. 그 가운데 무엇보다도 재정법적인 검토와 보완을 위한 특별법 개정은 반드시 이루어져야 한다.

영문 초록

The establishment of Gangwon Special Self－Governing Province can be said to follow the logic of differential decentralization considering the geographical, historical, and humanistic characteristics of Gangwon－do. There is a strong perception that the Gangwon Special Act was made hastily through political compromise ahead of the presidential and local elections. It is urgently requested to overcome the structural problems of the special law composed of Article 23 and supplementary provisions. Since Gangwon－do has many mountainous areas and is subject to extensive regulations such as military protection zones and water quality protection zones, Gangwon－do has structural weaknesses that make development itself difficult and economically backward. Therefore, in order to establish Gangwon－do as a special self－governing province, it is necessary to revive the symbolic meaning of going beyond war, division and conflict to the era of reconciliation and peace. In addition, it should be considered that Gangwon－do is designated as a UNESCO Biosphere Reserve in 2019, which means that the ecological environment conservation area is very significant. Considering these points, Gangwon Special Self－Governing Province has enough identity as an ‘international peace and ecology city’, and it is a great motivation to transform it into an area that will attract the attention of the world by developing an international peace and ecology city in an eco－friendly and exemplary way. it is possible to grant In order to realize the actual decentralization of Gangwon Special Self－Governing Province by taking advantage of these unique characteristics of Gangwon－do, it is necessary to revise and supplement the Gangwon－do Special Act. Above all, the revision of the Gangwon Special Act for the review and supplementation of the financial law must be made without fail.
