국문 초록

본 연구는 최근 10년 간 ‘법무보호’영역의 연구동향을 파악하여 향후 어떠한 부분에 초점을 두어 연구해야할 것인지 탐색하고자 시도되었다. 그 결과, ‘법무보호’의 역사는 약 100년이 넘었으나, 공단사업에 대한 학술적 접근은 보호관찰사업, 교정사업과 연관된 다른 학회의 연구실적에 비교하면 매우 미흡한 수준이라고 할 수 있다. 법무보호관련 논문들에서 제시하는 정책제언이나 개선방안을 종합해보면, 첫째 법무보호의 정체성 확립, 둘째 법무보호의 독자법률 제정, 셋째 회복중추기관으로서 공단역할 제고, 넷째 종전 생활관을 사회 내 중간처우 시설로 확대개편, 다섯째 필요적갱생보호제도의 도입, 여섯째 전문화된 자원봉사자로 역량 강화 등이었다. 이에 크게3가지 관점에서 논의가 필요한데, 첫째 한국법무보호복지학회의 정체성 확립, 둘째‘법무보호대상자의 회복에 관한 법률’의 제정, 셋째 자원봉사자 관리시스템의 전면개편 등을 논의가 필요한 주요한 연구초점으로 제시하였다.

영문 초록

This research was done to grasp research trends in the area of ‘rehabilitation’ and navigate what kind of research should be focused on in the future. As a result, the history of 'rehabilitation' is more than 100 years, but the academic approach of the public corporation's business turned out to be very insufficient, compared with the research achievements of other academic societies that are associated with probation, correction. To sum up the policy recommendations and improvement proposals presented in rehabilitation related papers, First, establishment of rehabilitation identity, Second, individual law of rehabilitation enactment, Third, improvement of the public corporation’s role as central organization of recovery, Fourth, extensive reorganization of previous living place into intermediate treatment facilities of society, Fifth, introduction of necessary rehabilitation system, and sixth, enhancement of competence as specialized volunteer were found to be needed. Therefore, three viewpoints that need to be discussed as focus of research are as follows. First, establishment of Korea Rehabilitation Association’s identity, Second, ‘law of restoration for subject of legal protection’ enactment, Third, full reorganization of the volunteer management system.
