지구대(파출소) 운용에 관한 비판적 고찰

국문 초록

개정된 「경찰법」이 시행됨에 따라, 치안업무는 ‘국가경찰사무(공공안전)’, ‘범죄수사’, ‘자치경찰사무’로 3원화되고, 국가경찰사무는 경찰청장이, 범죄수사는 국가수사본부장이, 자치경찰사무는 시·도자치경찰위원회가 각각 지휘·감독하게 되었지만, 경찰은 지구대(파출소)를 부당하게 운용함으로써 「경찰법」의 입법취지를 몰각하고 있다는 문제의식 하에서 본 연구가 기획되었다. 이 논문에서는 ① 지역경찰업무의 법적 성격, ② 지역경찰 지휘계통의 불합리성, ③ 「경찰공무원 임용령」상 자치경찰사무를 담당하는 경찰관의 범위, ④ 시·도자치경찰위원회의 실효적 지휘·감독권 행사와 같은 네 가지 쟁점을 도출하고 아래와 같은 논평을 전개하였다. 첫째, 지역경찰은 범죄수사에 관한 초동조치 업무를 제외하면 대부분의 시간을 자치경찰사무에 할애하고 있다. 둘째, 사실상 대부분의 자치경찰사무를 수행하는 지역경찰의 지휘선상에서 자치경찰업무를 전담하는 자치경찰부장이 배제된다면 자치경찰사무에 대한 시·도자치경찰위원회의 지휘·감독권이 유명무실하게 될 우려가 크다. 셋째, 「경찰법」 제24조 제1항 제3호에서는 시·도자치경찰위원회의 소관 사무로 “자치경찰사무 담당 공무원의 임용, 평가 및 인사위원회 운영”을 명시하고 있다. 하지만, 실질적으로 상당부분의 자치경찰사무를 수행하는 지역경찰을 「경찰공무원 임용령」 제4조 제1항에서 “시·도”의 “자치경찰사무를 담당하는 경찰공무원”의 범주에서 제외시킴으로써 시·도자치경찰위원회의 자치경찰사무 담당 공무원에 대한 인사권한을 무색하게 만들고 있다. 넷째, 「경찰법」 제28조 제3항에서는 “시·도경찰청장은 자치경찰사무에 대해서는 시·도자치경찰위원회의 지휘·감독을 받아 관할구역의 소관 사무를 관장하고 소속 공무원 및 소속 경찰기관의 장을 지휘·감독한다.”고 명시하고 있다. 하지만, ① 지역경찰업무를 자치경찰부가 아닌 112치안종합상황실에서 관장하고, ② 지역경찰을 “시·도”의 “자치경찰사무를 담당하는 경찰공무원”에서 제외시킴으로써 지역경찰이 수행하는 자치경찰사무에 대해서는 시·도자치경찰위원회가 지휘·감독권을 행사하기가 매우 어렵게 되었다는 점을 부인하기 어렵다. 정책적 제언으로 ① 「행정효율과 협업 촉진에 관한 규정」 활용, ② 자치경찰부(경찰서) 생활안전과와 112치안종합상황실의 협력체계 구축, ③ 시·도자치경찰위원회와 시·도경찰청간의 인사시스템 공유, ④ 시·도자치경찰위원회와 지역경찰간의 의사소통 채널 구축, ⑤ 자치경찰사무의 명문화. ⑥ 「경찰공무원 임용령」 개정을 각각 제시하였다.

영문 초록

With the implementation of the revised Police Act, security affairs were converted into “national police affairs (public safety),” “criminal investigation,” and “autonomous police affairs”. This study was planned under the awareness that the police are oblivious to the legislative purpose of the “Police Act” by unfairly operating a police district unit(police box). In this paper, four issues were derived and the following comments were developed. First, the local police spend most of their time on autonomous police affairs, except for the initial action on criminal investigations. Second, if the head of the autonomous police department in charge of autonomous police affairs is excluded from the command line of the local police, there is a high concern that the authority to command and supervise the municipal and provincial police committees on autonomous police affairs will become nominal. Third, the Police Act stipulates that the municipal and provincial police committees are in charge of the appointment and evaluation of public officials in charge of autonomous police affairs. However, by excluding local police officers who perform local police affairs from the category of “police officers in charge of autonomous police affairs” in Article 4 (1) of the Police Officials Appointment Order, the personnel authority of the municipal and provincial police committees is overshadowed. Fourth, Article 28 (3) of the Police Act stipulates, “The head of the city and provincial police shall take charge of autonomous police affairs under the direction and supervision of the city and provincial police committees.” However, it has become very difficult for the municipal and provincial police committees to exercise their command and supervision rights for local police affairs.
