양성평등에 관한 헌법개정상의 주요내용과 발전방향

국문 초록

양성평등에 관한 문제는 현재까지 사회적인 이슈로 되어오고 있고, 제10차 헌법개정에 주요한 논제로 되어 있다. 헌법전문을 위시하여 헌법 제11조 제1항에 양성평등을 천명하여 놓았고, 제32조 제4항에서 여성의 근로에 있어서 특별한 보호, 제34조 제3항에서 국가의 여성의 복지와 권익향상에 대한 국가의 책무, 제36조 제1항에서 혼인과 가족생활에서 국가의 보장, 동조 제2항에서 국가의 모성보호의무 등을 규정하고 있다. 양성평등이란 성별에 따른 차별, 편견, 비하 및 폭력없이 인권을 동등하게 보장받고 모든 영역에 동등하게 참여하고 대우받는 것을 의미한다. 헌법 제10차 개정과 관련하여 헌법개정특별위원회에서 발표한 양성평등 관련 주요 의제로서는 별도의 양성평등 규정을 신설하는 여부, 여성 근로의 특별보호, 여성의 공직진출에 있어서 양성평등 규정 신설, 혼인 및 가정에서의 양성평등, 여성의 복지 및 권익의 향상 조항 등이 있으나, 현재까지 2018 국회 특위, 국가인권위원회, 헌법개정여성연대, 대화아카데미 등에서 입장의 차이를 보이고 있다. 양성평등이라고 하는 개념은 남성과 여성의 성불평등한 관계의 변화에 초점을 두게 되어 제4차 산업혁명시대에 이분법화된 고정화된 성별분업형태를 가지고서는 가정, 기업, 국가경제를 원활이 이룰 수 없으며, 헌법이 개정하더라도 보호하고자 하는 인권보호측면에서 인간본질에 대한 깊은 성찰, 한국문화와 정서에 대한 이해, 법제도로의 수용절차 등 심사숙고해야 할 부분들이 존재한다. 촛불혁명으로 이루어진 새 정부는 국민의 염원과 뜻을 충분히 헌법에 충분히 반영하되, 우리의 역사를 대변하는 헌법인지라 형식적인 법개정이 아닌 실질적인 평등을 보장하는 수준까지 끌어올리려는 총체적인 노력을 통하여 철저하게 개정작업에 임하여야 할 것이다.

영문 초록

The equality of sexs has been a social issue so far and is a major reminder of the 10ᵗʰ constitutional amendment. The constitution provides the sexs equality in Article 11, Paragraph 1 of the Constitution. And there are Article 32 (4) in the special protection in women labour relation, Article 34 (3) in women welfare and the national responsibility, Article 36 (1) in national security in marriage and family life, Article 36 (2) in national maternity etc. The term ‘equaliy of sexs stipulate that the human rights between men and women are guaranteed without gender discrimination, prejudice, degradation and violence and they are equally involved and treated in all areas. It is necessary to establish a separate sexs equality regulation as a major agenda related to sexs equality which is published by the Special Committee on Constitutional Amendment in relation to the tenth amendment of the Constitution. There are discussions which contain a special provision for sexs equality, special protection for women labour, establishment of sexs equality in official position, equality in marriage and family life, women welfare and the improvement of rights and interests etc. However, until now there are diverse opinions containing the special committee for 2018 National Assembly, National Human Rights Commission, Women’s solidarity for Constitutional Amendment and Dialogue Academy. There are some parts to be considered, such as a deep reflection on human nature, an understanding of Korean culture and emotions if the Constitution is amended. Most of all, to the fully reflect the wishes and interests of the nation, the Constitution should be amended to bring it up to the level of guranteeing substantive equality between men and women.
