남북교류협력 지방분권화의 과정과 의미

국문 초록

이 연구는 남북교류협력 지방분권화 과정을 법·제도적 측면에서 살펴보고 거버넌스 확대 등 분권화 방안을 모색하였다. 지자체를 대북지원사업자로 인정하고 법률에 명시하게 된 2019년 이후의 법제도 변화 등 20년의 제도화 과정을 분석하였다. 중앙정부는 남북교류협력법 등 남북관계 법률을 제정하고, 남북교류와 교역, 협력사업 등에 관한 규정들을 마련하며 남북관계를 제도화하였다. 지자체도 남북교류협력사업의 주요 행위자로 참여하면서 남북사업의 분권화가 촉진되었다. 지자체는 남북교류협력사업을 위해 조례를 제정하고, 기금 조성과 남북교류협력위원회 구성, 담당부서 신설 등 독자적으로 사업을 추진할 수 있는 제도를 마련하였다. 지자체 남북교류협력도 남북관계와 중앙정부의 영향을 받아 김대중 정부와 노무현 정부에서는 활발하였으나, 이명박·박근혜 정부 때는 침체기를 겪으면서도 남북관계 개선을 위해 노력하였다. 문재인 정부는 남북관계 제도화와 분권화를 위해 지자체 주체성과 자율성을 확대하는 법·제도를 개선했다. 지자체가 법률상 주체성과 자율성을 확보하고, 중앙정부와 지자체, 지자체 간 협의구조도 만들어졌다. 지자체가 법적 지위를 얻은 것이 절차적 분권화였다면 이제는 실질적 분권화로 이행해야 한다. 사업 추진 역량을 강화하고 중앙과 지방의 협력체를 활성화하며, 지자체 간 다양한 거버넌스를 구축해야 한다.

영문 초록

This study examined the decentralization process of Inter-Korean exchange and cooperation in terms of law and institution, and sought ways to decentralize, such as expanding governance. The 20-year institutionalization process, including changes in the legal system after 2019 when local governments were recognized as supporters of North Korean related projects and specified in the law, was analyzed. The central government enacted Inter-Korean relations laws such as the Inter-Korean Exchange and Cooperation Act, and institutionalized Inter-Korean relations through preparation of regulations on Inter-Korean exchanges, trade, and cooperative projects. Local governments also participated as major actors in Inter-Korean exchange and cooperation projects, promoting decentralization of Inter-Korean projects. Local governments have enacted ordinances for Inter-Korean exchange, and have established independent system to promote projects, such as creating funds, establishing Inter-Korean exchange and cooperation committees, and departments in charge. Local governments' Inter-Korean exchange and cooperation were also active in the Kim Dae Jung’s and Roh Moo Hyun’s governments under the influence of the Inter-Korean relations of the active central government, but during the Park Geun Hye’s and Lee Myung Bak’s governments, they tried to improve Inter-Korean relations under the period of stagnation. The Moon Jae In’s government has improved the legal system to expand the subjectivity and autonomy of local governments in order to institutionalize and decentralize Inter-Korean relations. Local governments have secured legal subjectivity and autonomy, and a consultative structure has also been created between the central and local governments and local governments. If it was procedural decentralization that local governments gained legal status, they should now transition to practical decentralization. It is necessary to strengthen the capacity to carry out projects, revitalize central and local cooperatives, and establish various governance between local governments.
