‘사회적 난자동결’은 윤리적인가?

국문 초록

80년대 중반 등장한 난자동결기술은 본디 암 등의 치료를 앞두고 가임력 보존이 필요한 환자들을 위해 이용되었으나, 이제 일반 여성들을 위한 시술로 주목받고 있다. 여성들이 질병 때문이 아니라 아직 적절한 배우자를 만나지 못했거나 학업 또는 직업 등의 이유로 출산 시계를 늦추는 방안으로 자신의 난자를 동결하는 것을 ‘사회적 난자동결’이라 지칭할 수 있다. 이 글은 사회적 난자동결사례들이 우리 사회에도 점차 증가하고 있는 상황에 직면하여, 사회적 난자동결 이용의 윤리성에대한 검토를 여성의 삶과 안전 및 성별 형평성 등에 미치는 영향을 중심으로 수행하고자 한다. 그럼에도 이 글은 사회적 난자동결의 윤리성에 대해 ‘예’ 또는 ‘아니오’ 라는 구체적인 판단을제시하려는 것은 아니다. 하나의 논문에서 답을 제시하기에는 이 문제는 복합적이다. 국외의 논의를보면 사회적 난자동결이 여성의 삶과 성별 형평성에 미치는 긍정적인 영향과 부정적 영향에 대한논의들이 팽팽히 맞서고 있지만, 한국적 상황에서 그 영향력의 크기를 판단하기 위한 국내 연구는거의 없다. 또 이 문제는 정치적이기까지 한데, 한편으로는 재생산권이라는 여성의 인권 및 이 권리의 보장을 위해 요구되는 국가의 역할에 대한 검토가 필요하며, 다른 한편으로는 인구정책, 과학기술정책 등 정부의 다양한 정책들이 연계되어 있기 때문이다. 이러한 맥락에서 이 글은 사회적 난자동결의 윤리성을 판단하기 위해서는 해당 시술의 주요 당사자인 여성들을 포함한 사회구성원들이 적극 참여하는 공론화가 필요함과 함께, 공론장의 우선적 논의 주제로 이 사안에 대한 국가의 제도적 개입의 필요성, 방향 및 개입의 위험성 등에 대한 논의를제안하고자 한다. 이는 국가의 개입 여부 및 방향이 사회적 난자동결의 윤리적 이용을 위해 중요한역할을 할 것이라는 기대 때문이다. 아울러 이 글은 사회적 난자동결에 대한 시민들의 판단을 도울수 있는 국내 학계의 지원, 즉 여성의 삶과 안전 그리고 성별 형평성에 미치는 이익과 해악에 대한사회학적 연구와 기술적 효과성에 대한 의･과학적 후속 연구들이 시급하다는 점, 그리고 논의 과정에서 한국 사회의 특수한 정책적 맥락에서 사회적 난자동결의 이슈가 국가 중심적 인구통제 정책등 타 정책을 위해 수단화될 수 있는 위험도 통찰하고 경계해야 함을 제시했다.

영문 초록

Egg freezing technology, which emerged in the mid 1980s, originally used for medical reasons to preserve the fertility of women undergoing cancer treatment, is now being transformed as a procedure for general women. It is referred to as a “social egg freezing”, the act of freezing women’s eggs not because of illness but in order to defer or delay childbearing among women pursuing education and careers, or due to a lack of a stable partner. With social egg freezing steadily growing in the years in our society, this study intends to conduct a review of the ethics of social egg freezing focusing on the effects of general women’s use of this medical technique on their life, safety, and gender equity. Yet, this study does not intend to present a definite answer such as ‘yes’ or ‘no’ on the ethics of social egg freezing. This issue is complex and even political to be answered. First, it is complex. Discussions about the positive and negative effects of social egg freezing on women’s lives and gender equity are fiercely contested, but follow-up studies in Korea to determine the magnitude of the influence are still lacking. Also, it is political because various social policies including population and ST(Science & Technique) policy are closely connected to this issue. In this context, this study argues that in order to determine the ethics of “social egg freezing”, public deliberation is necessary with members of society, particularly including women, the main parties to this technology, actively participate. In addition, it suggests that the necessity, direction, and risk of the state’s institutional intervention that can protect, manage, and support the ethical use of social egg freezing in consideration of women’s life quality, safety and gender equity should be discussed as a main topic for public discussion. This is because of the expectation that the state’s intervention and direction will serve an important role for the ethical use of social egg freezing. Also, this study points out that there is an urgent need to support domestic legal, sociological, medical follow-up studies that can help the public make decisions on this issue in regards of benefits and harm to women’s reproductive rights, and technological effectiveness. Lastly, this study suggests that the public should be aware of the possibility that the risk of the life and gender equity of women may not be served as main considerations, but rather used as political means in the special policy context of Korean society.
