재난 및 안전 정책과정에서 정책학습 증거를 확인할 수 있는가?

국문 초록

2018년 김용균씨가 산재로 사망하였다. 이후 산재를 근절하기 위해 관련 법의 전부개정(’18년) 및 제정(‘21)이 이루어졌다. 하지만 여전히 매년 산업재해로 이천여 명이 사망하고 있다. 사건 중심 정책학습모형(ERPL)은 정책적 결과를 초점사건-학습-정책변동 관계에 입각하여 설명하 거나 향후 개선이 이루어질 수 있는 지점을 찾아낼 수 있다. 학습의 증거를 찾기 위하여 선행연 구를 종합하여 분석의 틀이 설계되었고, 이에 따라 국회 회의록을 포함한 다양한 문헌이 수집･ 분석되었다. 분석 결과, 사회적 정책학습이 주를 이루며 ’의무부과-처벌 메커니즘‘이 드러낸 한계를 보완할 대안적 관점인 ‘조사와 지원의 메커니즘’이 공식화되었다. 도구적 정책학습은 실효 성을 의심받는 기존 수단들의 보완 그리고 사회적 학습으로 새롭게 정의된 목표를 달성할 효과적 수단의 도입 과정에서 집중적으로 이루어졌다. 두 번의 정책변동이 있었으나, 적용범위의 급격한 확대는 향후 학술적･정책적 과제를 다룰 후속 연구의 필요를 정당화한다. 특히, 안전･보건 수준 향상을 위하여 안전을 바라보는 패러다임의 전환을 위한 학술적 탐구와 종합이 필요하다. 실무적으로, 다양한 중대재해 사례에 적합한 대안을 설계･집행할 수 있는 안전리더를 양성할 정책적 시도가 요구된다.

영문 초록

In 2018, Kim Yong-kyun died of an industrial accident. Since then, two bills have been adopted to eradicate industrial accidents. However, more than 2,000 people are still killed in industrial accidents every year. The event-related policy learning model (ERPL) can explain results based on a three-way relationship of focus event, learning and policy change or find points where future improvements can be made. In order to find evidence of learning, previous studies have been synthesized to design research and various documents including the minutes of the National Assembly were collected and analyzed. As a result, social policy learning was prevalent and the ‘mechanism of investigation and support’, an alternative perspective to compensate for the limitations revealed by the ‘obligation-punishment mechanism’, was formulated. Instrumental policy learning was intensively carried out in the process of supplementing existing means suspected of effectiveness and introducing effective means to achieve redefined goals through social learning. Although there have been two policy changes, the rapid expansion of the scope of application justifies the need for follow-up studies to deal with academic and policy challenges in the future. In particular, in order to improve the level of safety and health, academic exploration and synthesis are needed to change the paradigm of looking at safety. In practice, efforts are required to cultivate safety leaders who can design and execute alternatives suitable for various serious disaster cases.
