아파트 개발 사업의 실무적 난제 검토

국문 초록

본 연구 사례는 경기도 광주시 신현1지구 소재 624세대 아파트 신축사업으로서, 토지 매입 시부터 입주까지 무려 15년이 걸렸고, 그 중 13년은 법적 제한 사항 해소를 위해 소요된 사업이다. 양호한 입지성을 갖춘 사업지였음에도 불구하고, 착공 이후에도 시행사 내부적으로 분양 관리 업무를 제대로 수행하지 못해 분양률 저조를 경험하였고, 추후 시공사 등의 협력으로 분양 관리 업무를 정상화하여 성공적으로 사업을 마무리할 수 있게 된 프로젝트이다. 대규모 아파트 개발사업 시 발생할 수 있는 법적 제한 사항들에 대한 사전적 검토와 개발사업 진행 과정에서 발생 할 수 있는 운영상 위험요소들 중 하나인 분양 관리에 대한 사후적 해결방안을 파악하고자 하며, 향후 유사한 아파트 개발사업에서 제반 실무적 난제들에 대한 사전적 예방과 사후적 관리를 위한 유의미한 교훈을 제시하고자 한다.

영문 초록

This study case is a new 624 household apartment construction project located in Sinhyeon 1 district, Gwangju-si, Gyeonggi-do, and it took 15 years from the time of land purchase to moving in, of which 13 years were taken to resolve legal restrictions. Despite the fact that it was a project site with a good location, even after the start of construction, the real estate sales management task was not properly performed internally by the developer, so the sales rate was low. It is a project that has been able to successfully complete the project by normalizing the sales management through cooperation with the construction company. The purpose of this review is to examine the legal restrictions that may occur in the case of large-scale apartment development projects in advance and to identify ex-post solutions to the sales management, which is one of the operational risks that may occur in the course of the development project. and On the similar apartment development projects, this paper intends to present meaningful lessons for proactive prevention and follow-up management of various practical difficulties in the real estate development project.
