국문 초록

오늘날 남녀의 결합을 거부하는 혼인/출산/가정의 모습은 ‘시민결합’, ‘자발적 비혼모’, ‘아버지 존재의 부정’이라는 사회문화적 현상으로 나타나고 있다. 이러한 현상의 기저에 있는 여성주의 이론은 ‘여성의 성적 자기결정권 강화’, ‘성(Sexuality)과 출산의 소유권 인정’이라는 주장을 하였고 그 결과 가부장제의 부정적인 존재로 ‘아버지’를 거부하고, 남성은 협력과 상호보완의 존재가 아닌, 그저 생물학적 정자를 제공하는 존재로 전락시키고 출산의 과학화의 힘을 빌려 ‘자발적 비혼모’를 당당한 모습으로 그려내고 있다. 또한 남녀의 결합인 ‘결혼제도’와 ‘가족제도’의 폐지를 주장하였다. 오늘날 ‘시민결합제도’로 일컫는 이 제도는 결혼의 대안으로 전 세계적으로 확산중이며, 법리적 해석에서도 지지와 비판의 주장이 상충되고 있다. 이러한 현상의 배경적 이론으로서 여성주의 관점은 정치, 경제적 고려 없이 생물학적 차이에서 오는 차별로 이해하면서 구체적 해결 없이 남녀 대립을 강조하는 면이 많다는 비판을 받고 있다. 필자는 여성주의의 고립된 관점을 살피면서 동시에 인간학에 의거하여 남녀의 상실된 관계성을 회복하고, 상호간의 협력과 보완으로 어느 한쪽 성(性)이 소외되거나 배제되지 않고 인간의 삶이 영위롭게 조화를 이룰 수 있는 이론적이고 실천적 대안으로 ‘관계적 자율성’을 제안한다. 자기 결정권의 자율적 행위 능력의 약화 또는 감소 여부를 개인 차원으로만 국한하지 않고 그런 선택이 일어나게 된 상황을 주목하고, 그것을 변화시키는 것으로부터 문제 해결을 찾아야 한다는 것을 함의한다. 자기 결정의 배경으로 그 맥락적 요인들을 숙고와 서사를 통해 행위의 과정을 확인하고 그 해결책을 모색해야 할 것이다. 행위자의 정체성 형성은 사회화와 밀접한 관계가 있으므로 그 사회를 평가하고 구조를 변화시키는 것으로 확대해야 한다.

영문 초록

Today, the appearance of marriage/childbirth/family that rejects the union of men and women appears as a socio-cultural phenomenon such as ‘civil union’, ‘voluntary unmarried motherhood’, and ‘denial of father’s existence’. The feminist theory underlying this phenomenon argued that the strengthening of women s right to sexual self-determination and recognizing the ownership of sexuality and childbirth . Instead of cooperating and complementing each other, it is reduced to a being that simply provides biological sperm, and borrows the power of scientific procreation to portray voluntary single mothers in a dignified form. The feminist theory also argued for the abolition of the marriage system and the family system , which are the union of men and women. Today, this system, called the “civil union system,” is spreading around the world as an alternative to marriage, and there are conflicting arguments for support and criticism even in legal interpretation. As a background theory for this phenomenon, the feminist perspective is criticized for emphasizing gender confrontation without concrete resolution while understanding it as discrimination resulting from biological differences without political and economic considerations. While examining the isolated point of view of feminism, I restores the lost relationship between men and women based on anthropology, and through mutual cooperation and complementation, neither sex is alienated or excluded, and human life can be in harmony. We propose relational autonomy as a theoretical and practical alternative that can be achieved. Rather than limiting whether the ability to act autonomously of self-determination is weakening or diminishing at the individual level, it implies that we must pay attention to the circumstances in which such a choice is made and find a solution to the problem by changing it. As the background of self-determination, it is necessary to examine the contextual factors and identify the course of action through narrative and seek solutions. Since the identity formation of actors is closely related to socialization, it should be expanded to evaluate the society and change its structure.
