국문 초록

국토이용의 변화는 해당 지역의 역사적 변천과 함께 농경지 감소, 도시화, 간척사업 등 지역에서 발생되는 사회적·경제적 현상들이 잘 반영되어 지표로 나타난다. 특히 라선, 금강산, 개성, 신의주, 황금평·위화도, 신포, 남포는 북한의 경제특구 및 외국인기업 투자지대로서 앞으로의 북한 국토정책 방향과 개발계획을 이해하는 데에 매우 중요한 개방지역이라고 할 수 있다. 그동안 우리 기업은 남북교류 과정에서 개성공단과 금강산관광지구와 같이 북한의 국토를 일부 임차해 운영하는 방식의 교류협력을 추진해 왔다. 이런 과정을 통해 북한의 국토 관련 정책과 법제 분석이 매우 필수적임을 알 수 있었다. 따라서 본고에서는 북한의 국토 관련 정책과 법제에 대한 분석은 향후 남북한 통합과정에서도 대한민국 헌법 제3조(영토조항)와 결부될 것으로 예상하고, 나아가 우리 헌법이 국가목적 규정으로 제시하고 있는 이상 이에 대한 법제적 분석을 목적으로 하게 되었다. 본고에서는 먼저 북한 국토정책의 변천 사항 및 국토 관련 법제의 입법 연혁을 살펴보고, 북한 국토법제의 특성을 정리하였다. 그리고 북한의 국토 관련 법제의 입법 체계를 살펴보고, 그 헌법적 근거 규정과 개별 부문법제(국토계획법, 도시계획법, 토지임대법 등)를 고찰하였다. 마지막으로 한반도 공동번영을 위한 국토법제의 통합 방향 및 대응방안을 제시하였다.

영문 초록

The changes in national land use are shown as indices by fully reflecting not only the historical transition in the relevant region, but also the socioeconomic phenomena occurring in the region such as decrease of farmland, urbanization, and reclamation project. Especially, Rason, Mt. Kumgang, Gaeseong, Sinuiju, Hwanggumpyong/Wihwa-do, Shinpo, and Nampo are the special economic zones & foreign corporate investment zones of North Korea, so they are very important open regions for understanding the future direction of national land policy and development plan of North Korea. So far, South Korean companies have carried out the cooperative exchange in the method of operating the land of North Korea by partially leasing it like Gaeseong Industrial Complex and Mt. Kumgang Tourist District in the inter-Korean exchange process. Thus, it would be very essential to analyze the national land-related policies and legislation of North Korea. The analysis on the national land-related policies and legislation of North Korea would be related to the Article 3(territory clauses) of the Constitution of the Republic of Korea in the inter-Korean integration process in the future, and it is also presented as the provision of national purpose in the Constitution of the Republic of Korea. Therefore, this thesis aimed to analyze the legislation related to it. This thesis, first, examined the changes in national land policies and legislative history related to national land of North Korea, and then organized the characteristics of national land legislation of North Korea. And after examining the legislation system of land-related laws of North Korea, this thesis considered its constitutional ground provisions and individual laws(National Land Planning and Utilization Act, Urban Planning Act, Land Lease Act, and etc.). Lastly, the integrative direction of land-related laws and countermeasures for the co-prosperity on the Korean Peninsula were presented.
