국문 초록

본고(本稿)에서는 한국사회의 변화에 대한 한국민사법의 대응을 중심으로 한국민사법의 변화를 살펴보았다. 한국사회는 지난 60여년간 농경사회에서 시작하여 고도의 지능정보사회로 급속도로 그리고 압축적으로 발전하였다. 이러한 사회변화에 대하여 한국민사법이 탄력적으로 대응하여 이만한 경제발전과 문명사회를 이루었다고 긍정적으로 평가된다. 그러나 민사법의 대응에 있어서 가족법은 민법의 가족법 편이 적절히 대응하여 민법 중 가족법은 살아있는 민법으로 평가되나, 재산법은 민법 중 재산법의 개정에 의한 수정･보완보다는 수많은 민사특별법의 제정으로 대응하여 민법 중 재산법편은 사법(死法)이 많이 발생하게 되었다. 재산법의 현대화를 이루지 못한 것이 민사법의 가장 취약점이 아니었을까 평가된다. 앞으로의 사회는 극단적인 개인주의가 좀 억제되고 자유주의가 기초가 되고 공동체 주의가 가미된 개인의 인격의 자유로운 전개가 인정되고 가능한 협동사회, 연대사회, 공동체주의적 사회로 발전되어 나가야 하고, 개인도 이기적인 인간에서 도덕적 인간으로 인간상이 바뀌어 나가야 할 것이다. 이러한 새로운 미래 사회의 민사법은 기존의 페러다임으로는 이상적인 사회를 이루어갈 수 없을 것이다. 자유주의를 바탕으로 하면서 극단적인 개인주의를 극복하고 사랑과 정의를 이상과 내용으로 하는 사랑의 자연법적인 민사법의 법이론을 정립하고, 사랑의 자연법을 실정법인 민사법으로 규범화해 나가야 할 것이다. 만물의 근원은 사랑이며, 만사의 진행도 사랑으로 이루어지도록 하는 민사법으로 현행의 민사법을 수정･보완하여 발전시켜 나가야 할 것이다. 그리하여 한국민사법은 자연법적인 민사법으로 발전해 나가야함이 민사법의 과제이다. 그리고 민사법의 발전을 추구하기 위해서는 법학과 사회발전에 대한 학문분야와 학제간 연구의 병행이 강하게 요청된다. 법학이 결코 법의 영역 내에서만 발전을 추구할 수 없다. 인간에 대한 이해, 정치, 경제, 사회, 종교 등의 다양한 사회과학부문의 연구와 병행하여 연구가 이루어져야 정의와 사랑의 민사법을 창조해 나갈 수 있을 것이다.

영문 초록

In this paper, challenges in the Korean civil law had been examined with a focus on the policy response of Korean civil law to the transformation of Korean society. In the past 60 years, Korean society has developed remarkably from the agricultural society to the industrial state, and through the informative society. In this backdrop, it is highly required that the Korean Civil Act has flexibly responded to these social changes and achieved the economic development as well as civilized society. In responding to the civil law agenda, the family law responded appropriately to the family law side requirements. The family law is a branch of the civil laws, and is considered as a living civil law due to a succint policy response in cases. On the other hand, a scope of property laws had been nulled. It is viewed that the failure to modernize the property law was perhaps the weakest point of the civil law reform. In the future, the society should develop into a cooperative society, solidarity society, and communitarian society where any extreme individualism has to be somehow assuaged. The liberal constitutionalism ism is a pillar of nation, which enables a free development of individual personality and social integration on - communitarianian passion. The human paradigm also needs to change for moral order. The civil law of this transformative society will fail and hardly to achieve an ideal of law with the existing paradigm. Based on the value of liberal society, the policy response requires overcoming an extreme individualism, establishing a legal theory espousing the natural law of love and justice as the ideal substance, and standardizing the natural law of love as a positive civil law. The origin of all things is love, and the current civil law should be amended, supplemented with as well as developed as a civil law that allows all things to be done through love. Therefore, it is the task of civil law that the Korean civil law should develop into the province of natural order. In order to pursue the development of civil law, it is strongly required to effort on the interdisciplinary research across the academic fields of law and social development. Jurisprudence can neither develop nor flourish only within the realm of law. It will be possible to create a civil law of justice and love provided that the research is conducted in parallel with the academic achievements in various social science fields, such as humanity, political science, economics, sociology, and religion.
