국문 초록

오늘날 전 세계는 자국의 국익을 선제적으로 보호하기 위해 다양한 안보정책을 실시하고 있으며, 국가안보를 위협하는 역사적ㆍ정치적ㆍ군사적 상황과 배경에 적절한 법률을 시행하고 있다. 보통 국가안보사범의 범행은 일반적인 형사범죄와는 다르게 나타나고 있기 때문에 안보선진국에서는 특별법 형태의 예외적인 규정을 활용하여 선제적으로 대응하는 것이 공통적인 현상이다. 특히, 국가안보사범들은 고도로 훈련된 범죄전문가에 해당하며, 사법당국의 통제 하에서도 범행수법이 잘 드러나지 않기 때문에 범행수법과 행위 역시 예측하여 대응하는데 한계가 있을 수밖에 없다. 이에 주요 안보선진국가들이 안보위해사범에 대한 주요 법제에서 형사특별규정을 적용하는 이유는 안보위해범죄는 일반형사범죄와는 다른 범행의도, 수법, 행위태양 등이 나타나기 때문에 이에 적극적인 대응을 위한 정책과 법제를 시행해야 하는 점을 간과해서는 안 되며, 국가안보위해범죄는 국민 개인의 법익 침해와는 다른 양상과 결과를 수반하는 것을 반드시 주지하여야 한다.

영문 초록

Today, the world is implementing various security policies to proactively protect its interests. All countries have policies that are appropriate to the historical, political and military situations and backgrounds that threaten security. Usually, the National Security Crimes are different from that of ordinary criminal crimes. Therefore, it is a common phenomenon in advanced security countries to preemptively respond by using exceptional regulations in the form of special laws. In particular, the National Security Crimes are highly trained criminal experts, and there are limitations in predicting the crimes and behaviors because they are not well known even under the control of judicial authorities. The reason for applying the special provisions of criminal prosecution in the major legislation for security risk crimes in major security developed countries is that security risk crimes show different intentions, techniques, and behaviors than ordinary criminal crimes. In this regard, it should not be overlooked that policies and legislation for active response should be enforced, and it should be noted that crimes against national security involve different aspects and outcomes from infringement of the national interests of the people.
