管理團의 法的 地位에 관한 재검토

국문 초록

집합건물의 관리와 관련하여 관리권의 원활한 행사와 구분소유자의 권리 아닌 이익을 보장하기 위하여 관리단의 법적 지위를 명확히 정의하였다. 그리하여 본고에서는 관리단의 법적 지위를 집합건물의 관리사업을 수행하기 위한 구분소유자로 구성하는 권리능력 없는 사단으로정의하고, 그 구체적인 관리권의 행사의 주체로서 다음과 정의하였다. (1) 관리단은 집합건물의 관리를 위한 관리권의 귀속주체로서 관리단 사무에 관한 의사결정기관이며, 관리권행사 주체로서 지위를 가지며.(2) 관리단의 관리권의 행사는 특별한 제한이 없는 이상 관리권전반의 시행에 관련하여 관리단을 대표하여 행하는 재판상 또는 재판외의 행위, 그 밖에 규약에 정하여진 행위를 대내적으로는 물론이고, 대외적으로 행사할 소송상 또는 소송외 주체로서 지위를 가지고, (3) 또한,「주택법」상 입주자대표회의는 그 적법이 구성하였다는 것만으로 관리단의 지위를 갖는 것은 아니지만, 그 구성원이 입주자 전원으로 구성하고, 달리 관리단의 조직을 두고 있지 아니하는 때에는 소위「집합건물법」상 관리단과 동일한 지위를 가지는 것으로 요약된다.

영문 초록

Related with the management of the congregate Building, in order to guarantee the harmonious exercise of right of management and the profit of divided owner, which is not a right, clearly define the legal position of management. So in this dissertation, legal position of the management division is defined as an association which has no capacity of enjoyment of rights which consists of divided owners who accomplish the management enterprise of the aggregate building. And as a principal agent of a concrete exercise of right of management define this as follows. (1) As a principal agent to that is reverted the right of management. for the management of the congregate building, management division is a decision-making agency about a business of management division, and is a principal agent of the exercise of right of management. (2) If there is not a special limit, exercise of right of management of the management division has a position as a principal agent of the judicial or nonjudicial act, which exercise to represents a management division and of lawsuit or out of lawsuit that would internally or externally exercise the act which was made in the agreement. (3) Also just with a lawful organization, representative meeting of the occupant in the Law of House could not qualify the position as a management division. But if it is consisted with all of members and has not another management division, would have equal position with the management division in the Law of Aggregate Building
