부동산의 공동중개에 관한 연구

국문 초록

부동산거래를 신속하고 공정하게 중개하기 위해서는 개업공인중개사 간에 정보공유와 협력이 유효하기 때문에 공동중개가 점차 증가하고 있는 추세이다. 그러나 공동중개에 관해서는 법령에 규정이 없고, 공인중개사협회 차원의 자율적 규제도 미비하기 때문에 공동중개의 참여자 간에 분쟁이 발생하고 있다. 또한 공동중개에 관해서는 기초적인 실태조사와 분석은 물론 관련 연구 등도 현재는 미비한 실정이다. 따라서 본고에서는 이러한 문제의식하에 공동중개에 관한 이론적 고찰과 실태조사 및 분석을 행하고, 이를 토대로 다음과 같은 제도적 개선방안을 제시하였다. 첫째, 공동중개의 기본적 사항에 관한 입법적 보완이 필요하다. 둘째, 공인중개사협회 등을 통한 자율적 규제가 필요하다. 셋째, 공동중개를 위한 거래기반의 조성이 필요하다. 특히, 부동산거래정보망의 구축과 전속중개계약의 정착 등은 공동중개와 불가분의 관계에 있다.

영문 초록

Currently Joint real estate brokerage is gradually increasing because sharing information and cooperation between open licensed real estate agents are necessary in order to intermediate real estate business. However, disputes are arising between the participants in joint real estate brokerage because there is no regulation on the joint real estate brokerage in the law and because self-regulation at the level of Korea Association of Realtors is insufficient. And related researches as well as basic surveys and analyses one joint real estate brokerage are insufficient in the present situation. Thus, under the awareness of such problems, in this study theoretical consideration, condition survey and analysis on the joint real estate brokerage were conducted and systematic improvement plan were suggested as follows: First, legislative complement to the basic regulation on real estate brokerage is needed. Second, self-regulation is needed through Korea Association of Realtors etc. Third, trading business infrastructure for joint real estate brokerage is needed. Especially construction of the real estate transaction information network and settlement of exclusive agency listing and so forth, which are inseparably related to each other, are needed.
