공동주택단지 범죄예방 환경설계 전략 및 운영관리방안

국문 초록

요즘 우리 사회의 이웃 간의 무관심과 방관자적 자세는 공동체의 결속력을 저해시키는 요인이 되고 있다. 전통적으로 우리나라는 범죄인이나 외부의 적으로부터 이웃이나 공동체를 보호해 주는 인적요소 중심의 범죄예방시스템을 간직해 왔다. 하지만 21세기 사회구조의 변화 속에서 새로운 범죄예방정책을 대안으로 모색할 때이다. 그 대안 중의 하나가 범죄가 일어나는 공간의 물리적 환경에 관심을 두고, 그러한 환경의 설계 변화를 통해 범죄를 예방하고자 하는 이론인 범죄예방 환경설계(CPTED)이다. 우리나라에서 공동주택단지에 대한 CPTED의 구현은 ‘구축’과 ‘운영관리’ 측면 모두에서 아직은 과도기 단계라고 볼 수 있다. 따라서 CPTED의 ‘구축’ 측면에서는 단지 내 해당공간에 맞는 효율적인 전략으로 공간 구축을 해야 하며, ‘운영관리’ 측면에서는 CPTED의 지속적인 효과를 볼 수 있는 운영관리방안이 고안되어야 한다. 이에 본고에서는 ‘구축’ 측면에서 단지 내 공간을 단지 출입구, 담장, 조경 및 보행로, 주동 출입구, 경비실, 부대시설 및 복리시설, 지하 주차장, 배관설비, 승강기, 복도 및 계단, 세대 현관문 및 창문 등으로 구분한 후, 해당 공간마다 자연적 감시, 자연적 접근통제, 영역성, 활동성의 강화, 유지 및 관리 등 CPTED의 원리가 적절히 구현될 수 있는 차별화된 공간설계전략을 제시하였다. 다음으로 ‘운영관리’ 측면에서는 크게 세가지 입장에서 접근하였다. 첫째, CPTED 구축의 사각지대에 있는 공간에 대한 입법상의 확대 방안을 제안하였고, 방범설비 ‘운영관리기준’의 입법화를 위해서 공동주택 관리규약 준칙의 활용방안을 제시하였다. 둘째, CPTED 인증제를 활용한 운영관리시스템 정착방안으로서, 인증제를 법령화하는 동시에 공동주택단지 내 범죄가 자주 발생하는 특정 공간에 대한 인증과 재인증 제도를 의무화할 필요성을 제기하였다. 셋째, CPTED 설비관리를 위한 인적 요소의 강화방안으로서, 최저임금제 적용으로 인한 경비원의 변칙적 근무제 내지 해고 문제는 범죄예방에 역효과를 가져올 수 있다는 점을 상기시켰다. 넷째, 공간관리에 대한 경각심 제고방안으로서, 공동주택단지 내에서 CPTED의 운영관리 소홀로 인하여 범죄가 발생한 경우에는 범죄 가해자 이외에도 공동주택 관리주체에게도 손해배상책임(Premises Liability)을 인정하는 방향으로 사법적 풍토가 정착되어야 한다고 강조하였다.

영문 초록

Nowadays, the indifference of the neighbors and the attitude of the bystanders in our society are the factors that hinder the unity of the community. Traditionally, our country has a crime prevention system based on human factors that protects neighbors and communities from criminals or external enemies. In the 21st century, however, it is time to seek new crime prevention alternatives in the context of changes in social structure. One of the alternatives is CPTED, which is concerned with the physical environment of the place where the crime occurs, and the theory of preventing crime through such a change of environment. The implementation of CPTED for apartment complexes in Korea can be regarded as a beginner level in both ‘construction’ and ‘operation management’ aspects. Therefore, it is necessary to construct a space with an efficient strategy that fits the space in terms of ‘construction’ of the CPTED, and an operational management plan should be devised to show the continuous effect of the CPTED in terms of ‘operation management’. In this paper, in terms of ‘construction’, the space of apartment complex is divided into entrance, fence, landscape and walkway, main entrance, guard room, auxiliary facilities and welfare facilities, underground parking lot, plumbing facilities, elevator, hallway and stairs. Then, a differentiated strategy was proposed to apply the CPTED principle of natural monitoring, natural access control, territoriality, strengthening of activity, maintenance and management. Next, in terms of ‘operation management’, we approached from three points. First, I proposed a legislative expansion plan for the space in the blind spot of the CPTED construction, and proposed a plan to utilize the rules of the housing management code to legislate the operation management standard of the crime prevention facility. Second, it proposed to enact the certification system as the settlement system of the management system using the certification system and to enforce the certification system for the space in the housing complex. Third, as a way of strengthening the human factor for CPTED facility management, we objected to dismissal of security guards due to application of minimum wage system. Fourth, in order to raise awareness of space management, if there is a crime due to the lack of management and management of CPTED in the apartment complex, a judicial climate should be established to recognize the premises liability.
