국문 초록

이 글은 먼저 지난 30년간의 사형선고와 무기징역 선고 인원의 변화 추이를 살펴보았다. 1998년부터 사형집행이 중단되면서 2000년대 초반에 사형선고 건수가 급감하고, 무기징역 선고 건수도 감소하기 시작했다. 그리고 2010년대에 들어서 살인범죄 양형기준의 시행과 무기징역의 가석방기준을 강화한 형법개정을 통해 사형선고 인원은 연평균 1.9건에 불과하고, 무기징역 선고 건수도 급감하였다. 2010년 이후 무기징역 선고 인원은 1990년대 사형선고 인원과 비슷한 수준이 되었다. 사형선고는 아주 예외적인 사례에서 명목상 국가 최고형벌로서 상징적 기능만 수행하고 있다. 사형을 집행하지 아니하고 있고, 사형선고 건수도 극히 미미한데도 불구하고 사형을 법률적으로 폐지하지 못하는 이유는 국민 다수가 사형폐지에 반대하고 있기 때문이다. 그러나 2018년 국가인권위원회 실태조사에 따르면 사형을 대체할 수 있는적절한 형벌을 도입하면 사형폐지에 찬성하는 의견이 3분의 2에 가깝다. 그래서 현행 무기징역과 차별화된 종신형을 새로이 도입하여 실질적으로뿐만 아니라 법률적으로도 사형을 폐지할 수 있는 길을 모색하였다.

영문 초록

This article first analyzed the trend of changes in the number of people sentenced to death and life imprisonment over the past 30 years. As executions ceased in 1998, the number of death sentences plummeted in the early 2000s, and the number of life sentences began to decline. In the 2010s, due to the implementation of sentencing standards of murder and the revision of the Criminal Code with strengthened parole standard of life imprisonment, the number of people sentenced to death was only 1.9 per year, and the number of sentences to life imprisonment dropped sharply. Since 2010, the number of persons sentenced to life imprisonment became similar to that of the death sentence in the 1990s. Death sentence, in some very exceptional cases, serves only a symbolic function as nominally the strongest punishment of the state. Despite the absence of execution and low number of death sentences, death penalty is not legally abolished due to the opposition of the majority of the people. However, according to a survey by the National Human Rights Commission of Korea in 2018, close to two-thirds support the abolition of death penalty provided that an appropriate alternative is introduced. Therefore, a new life sentence, differentiated from the current life imprisonment, was sought out so that death penalty can be abolished not only practically but also legally.
