국문 초록

이 논문은 한국행정법학회 10년의 학술활동의 성과를 분석하고 행정기본법 제정이후의 전망을 모색하는 글이다. 한국행정법학회는 2010년 6월 25일 창립되었다. “10년이면 江山이 변한다”는 말이 있다. 한국행정법학회 창립 이래 10주년이 지나는 동안 학술발표회를 48회 개최하였고, 전문학술지인 행정법학을 20호까지 발간하였다. 아울러 2021년은 행정법학자에게는 행정기본법의 제정 공포로 새로운 변환점을 맞이한 원년으로 자리매김할 것이다. 이 논문에서는 학회 창립이후 10년간의 학술활동의 성과를 분석하면서, 1. 학술활동 개관 2. 정기학술대회(연합학술대회 포함)의 개최 3. 학술대회 기조발제 및 행정법학 수록 논문 현황 4. 학회지 행정법학의 학술논문 내용분석을 살펴보았다. 다음으로 행정기본법 제정 이후 전망을 하면서 1. 분석의 출발점: 행정법학회 10년의 학술적 성과와 한계 2. 새로운 행정법학 방법론의 모색 3. 행정기본법 제정의 의미 및 행정기본법과 행정소송법 개정 방향 5. 비판법학과 검토법학의 관점에서 행정기본법 시행령을 고찰하였다. 학회 창립 후 10여년의 기간 동안 한국행정법학회는 명실상부한 대표 행정법학회로 성장하였다. 한국행정법학회가 화합적 학문공동체로 출범하여 10여 년간 이룩한 업적은 실로 경이롭고 괄목할 만하다. 학회는 학자나 실무연구자가 자신의 연구성과를 발표하고 공유하는 학문적 소통의 공동체라고 할 것이다. 행정법학자는 비판적 관점에서 행정법에 관한 의견을 제시하고 법제도에 대한 검토와 분석을 통하여 법치주의의 궤도이탈을 통제하는 민권의 조력자이고, 정부정책의 바람직한 청사진을 제시하는 법제도의 설계자임을 잊어서는 안된다. 한국행정법학회는 개별 학회 차원의 학술대회가 아니라 이를 넘어서는 메타적인 주제나 새로운 주제를 발굴하여 논의하는 장을 마련하여야 한다. AI시대의 도래에 따라 학제적 접근을 넘어서서 융합 학문을 지향하는 개방적 협력체계가 필요하다. 제5회까지 이어져 오다가 중단된 행정법분야 연합학술대회를 격년제로 개최하되 행정법 관련 학회를 뛰어 넘어 인접 사회과학은 물론 주제에 따라 자연과학 분야의 관련 학회까지 포함하여 융합적 방법론을 발전시킬 필요가 있다. 한국의 행정법학을 대표하는 학술공동체의 위상에 걸맞게 한국행정법학회는 행정법학의 새로운 연구방향 모색과 행정법학의 외연 확장을 통하여 다가올 10년, 100년을 내다보면서 희망차게 큰 발을 내딛게 되길 기원한다.

영문 초록

This paper analyzes the achievements of academic activities performed by the Korean Administrative Law Association for the past 10 years and seeks the prospects after enactment of the General Act on Public Administration. The Korean Administrative Law Association was established on June 25, 2010. There is a saying, “In 10 years, even rivers and mountains change”. For the past 10 years since establishment of the Association, 48 academic presentations were held, and a total of 20 issues of our professional journal named ‘Administrative Law’ were published. For administrative law scholars, the year of 2021 will be positioned as the first year of a new turning point with enactment and promulgation of the General Act on Public Administration. This paper analyzes the achievements of academic activities performed for the past 10 years since establishment of the Association, and also reviews (i) Overview of academic activities, (ii) Hosting of regular academic conferences (including joint academic conferences), (iii) Keynote presentations at academic conferences and current status of administrative law papers presented, and (iv) Content analysis of administrative law papers inserted in the journal. Next, in connection with the prospects after enactment of the General Act on Public Administration, this paper also tried (i) Review of academic achievements and limitations of the Association for the past 10 years as the starting point of analysis, (ii) Searching for new administrative law science methodologies. (iii) Review of the meaning of enactment of the General Act on Public Administration and the directions of revision of the General Act on Public Administration and the Administrative Litigation Act, and (iv) Review of the Enforcement Decree of the General Act on Public Administration of the Ministry of Government Legislation from the perspective of critical and review law science. During the 10 years since its establishment, the Korean Administrative Law Association has grown into a representative administrative law society in name and reality. The achievements of the Korean Administrative Law Association over the past 10 years since its inception as a harmonious academic community are truly amazing and remarkable. The Association is a community of academic communication where scholars and practical researchers present and share their research results. Administrative law scholars should not forget that they are not only the advocates of civil rights that provide opinions on administrative law from a critical point of view and control deviations from the rule of law through review and analysis of the legal system, but also the designers of legal systems suggesting desirable blueprints for government policies. The Korean Administrative Law Association should not develop an academic conference at the level of an individual society, but provide a forum for discovering and discussing meta topics or new themes. With the advent of the AI era, needed is an open cooperative system going beyond an interdisciplinary approach and aiming for convergence studies. The joint academic conference in the field of administrative law, which was interrupted after the 5th one, is required to be held every other year in the advanced convergence methodology that goes beyond the administrative law-related society and includes not only the adjacent social sciences but also even the related academic societies in the natural science field depending on topic. Befitting the status of the academic community that represents the Korea s administrative law science, the Korean Administrative Law Association is required to take a big step looking forward to the next 10 or 100 years through search for new research directions and external extension.
