국문 초록

한국 고전 연구에 있어서 정본(定本)은 관련 학문의 원천을 제공한다는 측면에서 매우 중요하며, 정본을 만드는 과정에서 가장 중요한 것이 교감･표점이므로, 다양한 한국 고전 연구 활성화를 위해서는 교감･표점 등을 통한 정본화(定本化)를 장려할 필요가 있다고 할 것이다. 그러나 교감･표점을 장려하려면 그 결과물에 대한 법적 보호 방안이 요구될 수 있는데, 최근 대법원은 특별한 사정이 없으면 교감･표점 결과물에 창작성이 인정되기 어렵다고 보았다. 다만 대법원은 해당 사건에서 구체적 사정에 따라서 민법상 불법행위 법리에 의하여 교감･표점 결과물이 보호될 수 있음을 인정하였다. 그러나, 민법상 불법행위 법리 또는 부정경쟁방지법 (카)목에 따른 교감･표점의 보호는 구체적 사정 등에 따라 그 보호 여부가 좌우되는 등 일정한 한계가 있다. 따라서 교감･표점에 대한 인센티브 부여를 통한 정본화 장려를 위해서는 저작인접권 유사의 보호 방안도 검토해 볼 필요가 있을 것이다.

영문 초록

In the study of Korean literature in classical chinese, authentic texts are very important in terms of providing the source of related studies, and the most important thing in the process of making an authentic text is text correction and punctuation68). In order to encourage to make authentic texts through text correction and punctuation, a legal protection for text correction and punctuation is required. Recently, Supreme Court of Korea held that it was difficult to recognize creativity in the results of text correction and punctuation unless there were special circumstances. However, the Supreme Court recognized that, depending on the specific circumstances in the case, the results of text correction and punctuation may be protected according to the tort law under the CIVIL ACT. But, the protection of text correction and punctuation under the CIVIL ACT or the UNFAIR COMPETITION PREVENTION AND TRADE SECRET PROTECTION ACT may depend on specific circumstances. Therefore, in order to encourage to make authentic texts through incentives, it is necessary to consider granting copyright or neighboring right to authors of text correction and punctuation.
