저작권의 헌법적 기초에 관한 연구

국문 초록

저작권의 헌법적 기초는 헌법 제22조 제2항과 제23조에서 찾을 수 있다. 위 두 헌법규정이 저작권의 헌법적 기초 혹은 근거가 되고 있지만, 그 규정 사이에서 그 적용에 있어 우선 여부를 가린다면 헌법 제22조 제2항이 제23조의 재산권 규정보다 우선적으로 고려되어야 하는 조항이라고 보아야 하겠다. 헌법 제22조 제2항은 그 자체로 저작권의 재산적 이익과 인격적 이익 모두를 권리로서 보호하는 헌법적 근거가 될 수 있기 때문이다. 이는 헌법 제22조 제2항이 저작권의 헌법적 근거로 먼저 검토된다는 의미로 이해되어야 하고, 저작권의 헌법적 근거를 헌법 제22조 제2항으로 한정하여 볼 것은 아니라는 것이다. 특히 저작권의 제한 및 그 해석 등에 있어서는 기존의 재산권의 법리도 중요하게 고려되어야 한다는 점에서 헌법 제23조가 중요한 헌법적 근거 된다고 보아야 한다. 따라서 헌법 제22조 제2항과 제23조를 저작권 및 그 제한에 관한 해석에 있어 중첩적으로 적용되어야 하는 헌법 규정으로 이해하는 것이 우리 헌법과 저작권 관계법을 해석하고 적용함에 있어서 타당한 입장으로 판단된다. 한편, 저작권법의 목적 조항을 해석함에 있어서도, 나아가 저작자의 저작재산권 및 저작인접권자의 재산권을 이해함에 있어서도 마찬가지로 헌법상 재산권의 영역에 속하는 것으로 그 범위와 한계에 대하여 헌법 해석상 논의가 필요하다. 이를 전제로 하여, 본 연구에서는 우리 헌법과 관련되어 있는 저작권법 다양한 쟁점중 저작권과 표현의 자유 간의 권리 충돌 상황에서 일정한 경우, 표현의 자유가 저작권 침해 여부 판단과 관련하여 일정한 헌법적 해석에 따른 한계를 제시할 수 있다는 점을 검토하였다. 또한 저작권 제한 사유로 외국 입법례에서 인정되고 있는 패러디, 패스티시, 캐리커처 등에서 그 정당성의 근거를 고찰하여 보면, 더 나아가 표현의 자유를 근거로 저작권 제한의 가능성이 있다는 점을 검토하여야 할 것인지에 대하여 추가적 논의가 필요하다는 점과 헌법상 저작물 이용자의 권리 또는 이익의 근거가 무엇인지에 관해서 앞으로 연구해야 할 과제라는 점에 대하여 살펴보았다.

영문 초록

The constitutional basis of copyright can be found simultaneously in Articles 22 (2) and 23 of the Korean Constitution. Although the provisions are the constitutional basis or basis of copyright, Article 22 (2) of the Korean Constitution should be considered preferentially over Article 23 covering the property rights, when the application is determined between the two provisions. This is because Article 22 (2) of the Korean Constitution may itself be a constitutional basis for protecting both the proprietary interests and personal interests of copyright as rights. That Article 22 (2) of the Korean Constitution should be given a priority means that this article is to be preferentially examined as a constitutional basis for copyright, not Article 22 (2) of the Korean Constitution is only constitutional basis of copyright. Article 23 of the Korean Constitution should also be regarded as an important constitutional basis in that the legal principles of existing property rights should also be considered important when it comes to copyright restrictions. Consequently, Article 22 (2) and Article 23 of the Korean Constitution are provisions to be applied to copyrights in an overlapping manner. Meanwhile, the purpose of the Copyright Act is “to contribute to the improvement of culture and related industries by protecting the rights of the author and the rights adjacent thereto and promoting fair use of the works.” Considering the economic rights owner of copyright and neighboring right property rights belong to proprietary right under the Korean Constitution, constitutional interpretations of its scope and limitations are inevitable. This article analyzes copyright issues related to the Korean Constitution, focusing on the conflict between copyright and freedom of expression and noted that freedom of expression can be taken into consideration in determining copyright infringement. Furthermore, this article addresses that further discussion on whether limitations on copyrights based on freedom of expression are possible is needed, noting that foreign legal systems allows fair use with a copyright work for the purposes of caricature, parody or pastiche.
