영문 초록

The Trade measures through Non-Product Related Processes and Production Methods (NPR PPMs) is used to prevent environmental and health problems arising from the process of production or capture that are distinct from the characteristics of the final product. As a general exception, the WTO allows these measures to be taken in order to address these issues, but, in the case of NPR PPMs, there is no specified regulation in the WTO and it brings debates continuously. This study examines the US-Shrimp (1996), US-Tuna II (2008), and EC-Seal Product (2009) cases with NPR PPMs and analyzes the panel and Appellate body rulings in these cases to see if they are applicable to the WTO.
