국문 초록

현대 사회의 국가안보를 위협하는 요인과 환경의 패러다임은 과거 전통적인 상황과 다른 양상을 지니고 있다. 국가안보사범은 일반형사범과는 다른 특징이 있다. 먼저, 피해자와 피해사실의 특정이 어려워 첩보수집이 어렵고, 범행의 모의나 실행이 국외에서 주로 이루어져 장기간의 내사가 필요하며 증거수집의 한계가 있다. 그리고 수사의 모든 과정에서 고도의 보안이 요구되며, 대부분 확신범이어서 자백을 받아내기 어렵다. 아울러 정치 및 이념적 배경을 가지고 있어 수사방해 행위가 빈번하다. 따라서 국가안보를 위협하는 요소를 사전에 차단하고 국민의 생명과 재산을 보호하기 위해 정보ㆍ수사기관은 모든 정보수집역량을 발휘하고 집중해야만 한다.

영문 초록

The paradigm of environment and factors that threaten the national security of modern society is different from the traditional situation in the past. National security crimes are different from ordinary criminal crimes. First, it is difficult to collect victims because of the difficulty in identifying victims, and the execution and simulation of the crime are mainly carried out abroad. And all the processes of investigation require high security, and most of them are confident and difficult to confess. In addition, they have political and ideological backgrounds, which frequently interfere with investigation. Therefore, in order to prevent threats to national security in advance and to protect people s lives and property, intelligence and investigation agencies should exercise and concentrate all information gathering capabilities.
