영문 초록

Discusses a capital punishment system to be, the life and human rights change are one value which is not. And today direction of a ceremony the which time the proper recognition is demanded more about value of dignity and life of the human being. Also this writing is developed until now and with attitude of essence and judicial precedent criticizing leads tries about capital punishment system and right to life to investigate the whether to be unconstitutionality, the reporter to present the plan which is concrete for the abolition of capital punishment system does. From this cause as the punishment system the capital punishment will be able to respect a life and a human rights the reporter the ideal and the real to grope the harmonize junction does. Abolishes a capital punishment immediately, some day must be abolished necessary because difficult to adopt the plan which is phased with aim. Sentences the absolute life imprisonment which is not parole to between capital punishment and life sentence, the duration when is fixed elapses and regrets and according to degree to operate a relative life imprisonment elastically. When and the social atmosphere matures more, special legal establishment by law to lead and is a strategy whose is actual to go out with the direction of perfection abolition.
