지방자치단체의 공공건설공사 시공평가에 대한 법적 고찰

국문 초록

지방계약법 제42조 및 건설기술 진흥법 제50조에 따라 건설기술 진흥법상 시공평가의 실시의무가 일정규모 이상의 건설공사를 발주하는 지방자치단체를 기속하고 있는 실정이다. 따라서 시공평가 결과는 지방자치단체가 공공건설공사의 낙찰자 결정 등의 행정행위를 함에 있어 중요한 고려 대상이라고 할 수 있다. 이에 이 글은 지방자치단체의 공공건설공사 계약에 작용되는 건설기술 진흥법상 시공평가제도의 의미와 지방 행정법적 쟁점, 그리고 그의 법제도적 현황을 고찰하였다. 이후 위 검토된 사항들을 토대로 지방자치단체의 시공평가 전문성 강화를 위한 법제도적 개선 방안을 제안하는 것으로 결론에 갈음하고자 하였다. 이 글에 따르면, 지방자치단체에 의한 시공평가는 공공건설공사의 입찰참가를 사전에 제한하는 효력을 가지고 있는 사전능력평제도로서 행정 결정의 척도가 되므로 중요한 법적 의미를 지닌다. 따라서 부실한 공문서의 통제, 포괄적 재량의 부여, 지방자치단체에 의한 적극적인 권한의 행사 등을 위한 법적 논의의 구체화가 필요하다. 이러한 지방 행정법적 논의의 필요성과 방향을 구체화하는 현황 분석으로서 현행법률, 하위 법령 및 지침, 유권해석의 사례들을 살펴본 결과 다음과 같은 시사점을 발견할 수 있었다. 첫째, 건설기술 진흥법은 국가 및 지방자치단체가 시공평가의 기준과 항목 등을 설정하는 원칙, 의무 등에 관한 사항을 선언하여, 시공평가의 객관성･정확성 등의 향상을 위해 이바지할 수 있어야 한다. 더불어, 국토교통부 ｢건설기술용역 및 시공 평가지침｣뿐만 아니라 지방자치단체 ｢건설기술용역 및 시공 평가지침｣에 근거하는 사항에 대한 명시적인 위임규정이 도입되어야 한다. 둘째, 건설기술 진흥법 시행령은 위의 원칙과 의무에 근거하여 기초지방자치단체 ｢건설기술용역 및 시공 평가지침｣에 더 많은 자율성을 부여하여야 한다. 셋째, 천편일률적인 기초지방자치단체 ｢건설기술용역 및 시공 평가지침｣을 구체화･다양화하기 위해, 지방자치단체는 건설법무 전문성을 향상시켜 나아가기 위해 더욱 노력하여야 한다. 다만, 이 글은 지방자치단체 시공평가제도의 법적 구조와 체계를 파악하는 데에 더 집중하고자 했다. 이로 인해, 적극적인 법해석 또는 입법적 개선방안을 제안하지 못했고, 지방자치단체 시공평가에 관한 업무 실태 파악에 관한 실증적인 연구를 진행하지 못한 한계가 있다.

영문 초록

The Local Contract Act and the Construction Technology Promotion Act shall enforce the construction evaluation of local government construction works. Therefore, the results of the construction evaluation are an important evaluation factor when local governments decide the successful bidder for the construction work. This article presents the meaning of the construction evaluation system, legal issues, and legal status of the construction evaluation system under the Construction Technology Promotion Act, which is applied to public construction contracts of local governments. In conclusion, the government proposes a plan to strengthen the expertise of construction evaluation based on the analysis of current status. According to this article, the construction evaluation by local governments has the effect of limiting the participation of public construction projects in advance. In other words, it has legal significance as a pre-ability evaluation system. Therefore, legal discussions are needed to urge strict management of administrative documents, strengthening discretion, and active administration. These legal issues can be materialized through current laws, subordinate statutes, guidelines, and interpretation of voters. Based on the above analysis, the following improvement measures are proposed: First, the Construction Technology Promotion Act shall be able to contribute to the improvement of the objectivity, accuracy, etc. of construction evaluation by the State and local governments. To this end, local governments shall introduce delegation regulations for construction technology services and construction evaluation guidelines. Second, the Enforcement Decree of the Construction Technology Promotion Act shall grant more autonomy to the basic local government s Construction Technology Services and Construction Evaluation Guidelines. Third, the basic local governments ｢Guidelines for Construction Technology Services and Construction Evaluation｣ shall be embodied. This contributes to improving the architectural administration expertise of local governments.
