A Critical Review of the EU’s Digital Markets Act: Possible Impacts on the Digital Economy

국문 초록

최근 제4차 산업혁명에서의 역동적 발전은 디지털 시장경제에서의 공공정책에 상당한 영향을 주고 있다. 급속한 디지털경제의 발전은 다양한 문제를 발생시키고 있으며, 관련하여 대규모 플랫폼의 사업모델에 대한 입법논의가 많이 이루어지고 있다. 특히 유럽연합의 최근 몇 년간 이루어진 디지털정책과 경쟁법집행의 내용은 대규모 플랫폼 사업자에 대한 적극적인 규제로 이어지고 있다. 유럽집행위원회(European Commission)는 미국의 대규모 플랫폼 사업자가 유럽경쟁법 기능조약 제102조를 위반했다는 결정을 하거나 조사를 진행하고 있는데, 이러한 내용이 유럽경쟁당국의 최근 규제방향을 보여준다. 유럽에서의 대규모 플랫폼 사업자에 의한 시장집중도 및 시장력에 대한 우려는 다양한 입법안을 통해 논의되었는데, 2020년 12월 발표된 디지털서비스법과 디지털시장법이 가장 중요한 최근 법안이라 할 수 있다. 국내외에서 디지털 관련 입법 논의가 다양하게 이루어지고 있는 상황에서 유럽 디지털시장법안의 내용은 향후 디지털 경제규제에 대한 국제적 수렴화로 논의될 수 있다. 따라서 위 규제의 내용을 살펴보고 향후 발전방향을 예상하는 것은 의미가 있다. 또한 유럽 디지털시장법은 국내 사업자에게 영향을 줄 수 있다. 경쟁법의 역외적용이 일반화되어 있는 상황에서 유럽경쟁당국이 우리나라 기업을 규제대상으로 지정하여 의무를 부과할 수 있기 때문이다. 유럽연합의 최근 입법의 동향과 사전규제적인 성격의 디지털시장법안의 내용은 온라인 플랫폼 사업자에 대한 경쟁법 적용의 어려움이 그 배경이 된다. 양면시장에서의 시장획정의 어려움을 포함하여 새로운 형태의 남용행위에 대한 경쟁제한성 증명 등이 실무적인 문제로 등장하였다. 이러한 문제를 회피하고자 유럽집행위원회는 디지털시장법안을 제안하는 것으로 보인다. 그러나 위 법안의 내용은 급진적인 성격의 사전규제 내용을 담고 있으며, 파괴적 혁신이 중요하게 고려되는 디지털경제에서 오히려 시장에 부정적인 영향을 줄 수 있다. 따라서 디지털 관련 경쟁정책을 수립하는 과정에서 역동적 효율성과 시장을 위한 경쟁(competition for the market)을 고려해야 한다. 마지막으로 온라인 플랫폼 관련 규제를 고려한다면 소비자후생 증진을 가장 중요한 목적으로 두여야 한다. 디지털사회에서의 소비자후생은 낮은 가격, 높은 품질, 소비자선택, 혁신의 증진을 포함하는데, 최근 유럽에서는 Facebook사건에서와 같이 프라이버시를 소비자후생에 포함하는 논의가 진행 중이다. 본 연구는 이러한 내용을 중심으로 유럽 디지털시장법안과 관련된 다양한 문제들을 논의하고 향후 경쟁법과 정책의 발전에 대해서 제언하고자 한다.

영문 초록

The recent development of dynamic technologies has affected governmental policies on the digital economy. This has also led to rapid progress on the enactments of new approaches to the business models of large online platforms in the global market. In particular, the stringent approaches of the EU against large platforms appear imperative. The European Commission’s vigorous applications of Article 102 TFEU explain its concerns over the economic concentration of large platforms. Facing this issue, the European Commission has recently proposed for the Digital Services Act and the Digital Markets Act (DMA) to ensure appropriate functioning of the European market. Its proposals have been severely discussed around the world. It is meaningful to examine the DMA and discuss whether the DMA can be considered as a global trend in competition law. We also need to consider possible applications of the DMA to Korean firms because of the increasing expansion of competition law in the global market. Due to the absence of a clear-cut case of market definition with respect to online platforms, the European Commission proposes the DMA to avoid a heavy burden of proof. However, a radical change to the existing competition rules may bring negative effects on the market and economy. Therefore, competition policymakers need to consider the importance of dynamic efficiency and competition for the market in the cutting-edge digital economy. Lastly, online platforms can improve consumer welfare. We should consider the priority of consumer welfare standards that cover low price, high quality, wide choice, better innovation and privacy. This article aims to discuss various issues within the DMA, thereby to provide suggestions for future competition policy.
