인권측면에서 경찰의 정신질환자 입원에 대한 문제점 및 개선방안

국문 초록

경찰이 야간에 정신질환자 관련 신고를 받고 입원조치를 하는 과정에서 10시간동안 입원 가능한 병원을 찾고, 병원을 찾지 못해 7시간동안 관서에서 보호조치를 해야 했던 사례와, 2019년 진주 방화살인사건에서도 사건 이전에 여러차례 신고가 들어왔지만 입원조치를 하지 못했던 사례로 알 수 있듯이, 그 당시 출동 경찰관들이 정신질환자 신고에 대한 명확한 처리 규정이 없어 혼란을 겪고 있다. 경찰청 내부망인 폴넷 사이트의 현장활력소에서 이와 유사한 사례들로 경찰관이 정신질환자 신고 처리에서 마주하고 있는 문제점들이 게시되어 있다. 정신질환자의 입원조치사항은「정신건강보건법」상 제41조(자의입원) 제42조(동의입원) 제43조(보호입원) 제44조(행정입원) 제50조(응급입원)으로 규정되어 있지만, 정신분야에 관련한 지방자치단체 기관들과 연계가 제대로 이루어지고 있지 않다. 이에 대한 대안책으로 법적인 측면, 관련기관과의 연계적 측면, 제도적 측면에서 제시하였다. 법 규정의 명확성 확보와, 경찰업무 현장지침을 구체적이고 현실성 있게 조정할 필요성과, 미국의 CIT(위기개입팀)과 대만 타이베이시의 긴급의료제도를 통해 외국의 정신질환자 대응의 좋은 방안을 마케팅 하였으면 한다.

영문 초록

As can be seen from cases where police had to visit hospitals that could be hospitalized for 10 hours at night while receiving reports on mentally ill patients and had to take protective measures for 7 hours because they couldn t find a hospital, and from the 2019 Jinju arson murder case, there were several reports before the incident, but failed to take them into the hospital, the dispatched officers were confused by the lack of clear rules for handling reports on mentally ill patients. Similar cases at the on-site activity center of the police agency s internal network, the Polnet site, have posted problems police officers face in handling reports of mental illnesses. The hospitalization measures for mentally ill patients are stipulated in Article 41 (self-admission), Article 42 (consent admission), Article 43 (protective admission), Article 44 (administrative admission), and Article 50 (emergency hospitalization), but they are not properly linked to local government agencies related to the mental sector. As an alternative to this, it was proposed in terms of legal aspects, linkage with related agencies, and institutional aspects. It is hoped that the government will secure the clarity of the law regulations, the need to adjust the field guidelines for police work in a concrete and realistic manner, and to market good ways to respond to foreign mental patients through the emergency medical system of the U.S. Crisis Intervention Team (CIT) and Taipei City, Taiwan.
